Child sex crimes: EP to crack down on child abusers and web pornography

Child abusers and viewers of child sex images on the web would face tough penalties for abuse, exploitation and pornography offences under draft EU rules as agreed with Council representatives and approved by the Civil Liberties Committee on Tuesday. The rules would also require EU Member States to remove child porn web sites, or, failing that, make it possible to block access to them within their territory, if a Member State so decides.

"The new directive to combat sexual abuse and exploitation of children and child pornography is an innovative legislative instrument and represents a step forward for the protection of our children. The text will be at the disposal of the competent authorities and NGOs, so that there is zero tolerance against all crimes against children" said Roberta Angelilli (EPP, IT), who is steering the legislation through Parliament.

Tougher penalties for child abusers...

The draft directive sets out minimum penalties for about 20 criminal offences to do with sexual abuse, sexual exploitation and child pornography - far more than are usually provided for in EU legislation. The draft has been agreed with the Council of Ministers representatives, subject to Parliament's plenary vote in September 2011.

MEPs fought for tougher penalties across the EU, especially in cases of abuse by persons in a position of trust, authority or influence over the child (e.g. family members, guardians or teachers) or abuse of particularly vulnerable children (e.g. those with a physical or mental disability or under the influence of drugs or alcohol).

Offenders could face penalties ranging from one to at least ten years in prison, depending on the crime (since the draft directive lays down only minimum penalties, Member States could impose harsher measures and sentencing). For instance, causing a child to witness sexual activities could be punishable by one year in prison, and coercing a child into sexual actions by ten. Attending pornographic performances involving children could by punishable by at least two years in prison, and forcing a child into prostitution by at least ten. Child pornography producers could face at least three years in prison, whilst those possessing it would face at least one year.

... and child pornography viewers

"Knowingly obtaining access" by means of information and communication technology to child pornography would also be a crime. To be liable to prosecution, a person would have both intend to enter a site containing child pornography and know that such images could be found there.

Child porn web pages must go...

Parliament’s negotiating team have, from the outset, advocated complete removal of web pages containing or disseminating child pornography. These web pages must be removed, they say, as blocking access to them, as initially proposed by the Commission, has proved not to be entirely effective.

Moreover, removal at source would be more reassuring for children, given that images to which access is merely blocked could still be somewhere in cyberspace, they add. MEPs have ensured that the text requires Member States to ensure the prompt removal of web pages hosted in their territory. They must also co-operate with third countries to obtain the removal of pages hosted outside the EU.

... but blocking may still be needed

However, the removal of child pornography content at its source is often not possible (e.g. because the state where servers are hosted is unwilling to co-operate or because removal would take too long). In these cases, Member States may block access to those pages for internet users in their territory, says the text agreed with the Council.

"Let's be clear: we are not talking about censorship here, we are talking just and only about child pornography - images, photographs, films or clips in which a crime against children is clearly being committed", said Ms Angelilli. These measures to block access to web pages would have to follow transparent procedures and provide adequate safeguards. Users would have to be informed of the reason for the restriction and have the possibility of judicial redress, says the text.

EU-wide criminalization of on-line "grooming"

New forms of abuse and exploitation, such as on-line "grooming" (befriending children via the web with the intention of sexually abusing them) or making children pose sexually in front of web cameras, would be a crime.

Child sex tourism

"Sex tourists" travelling abroad to abuse children would also face prosecution, under new rules on jurisdiction. The text introduces the concept of "child sex tourism" for the first time in EU legislation. Member States would have to ban travel arrangements for the purpose of child sex tourism. Other measures, e.g. a code of conduct in the tourism industry or "quality labels" for tourist organisations combating child sex tourism, should also be promoted, says the text.

Ban on working with children

Since some 20% of sex offenders go on to commit further offences after conviction, the text stipulates that convicted offenders "may be temporarily or permanently prevented from exercising at least professional activities involving direct and regular contacts with children". Employers when recruiting would be entitled to request information on convictions for sexual offences against children. Member States would also be entitled to take other measures, such as listing convicted persons in "sex offender registers".

Protecting victims

MEPs have also strengthened rules on assisting, supporting and protecting victims, e.g. to ensure that they have easy access to legal remedies and suffer as little as possible from participating in criminal investigations and trials. MEPs have also added a specific article incorporating child sex crime prevention within the scope of the directive. Studies suggest that between 10% and 20% of minors in Europe may be sexually assaulted during childhood.

Next steps

The agreement is to be put to the vote by Parliament as a whole at the September II plenary session and should be formally adopted by the Council of Ministers shortly thereafter. Once adopted, this directive will replace current EU legislation dating from 2004. Member States will have two years to transpose the new rules into their national laws. The UK and Ireland have notified their wish to take part in the adoption and application of this directive. Denmark is the only Member State not taking part.

ΕΔΑΔ: Απόφαση για την ελευθερία της έκφρασης και την παιδική πορνογραφία


To Ευρωπαϊκό Δικαστήριο Ανθρωπίνων Δικαιωμάτων εξέδωσε στις 10.5.2011 απόφαση (αίτηση αριθ. 1685/10 της Ulla Annikki KARTTUNEN κατά Φινλανδίας με την οποία έκρινε ότι η δημοσίευση υλικού παιδικής πορνογραφίας στο πλαίσιο ενός έργου τέχνης δεν εμπίπτει στην προστασία της ελευθερίας έκφρασης του άρθρου 10 ΕΣΔΑ.

Η διαδικασία ενώπιον του ΕΔΑΔ αφορούσε την έκθεση το 2008 („Neitsythuorakirkko“, „Εκκλησία παρθένων πορνών“) μιας φινλανδής καλλιτέχνιδας που περιείχε πάνω από 100 πορνογραφικές εικόνες ανήλικων κοριτσιών και γυναικών. Η καλλιτέχνης χρησιμοποίησε φωτογραφίες από δημόσια προσβάσιμες ιστοσελίδες. Μετά την έκθεση οι εικόνες κατασχέθηκαν από την αστυνομία και η καλλιτέχνις καταδικάσθηκε για την έκθεση πορνογραφικών εικόνων.

Η εν λόγω καλλιτέχνης αφού εξάντλησε τα ένδικα μέσα άσκησε προσφυγή στο ΕΔΑΔ ισχυριζόμενη ότι παραβιάσθηκε το άρθρο 10 ΕΣΔΑ και ειδικότερα, ότι παραβιάσθηκε το δικαίωμά της στην ελεύθερη έκφραση ως καλλιτέχνιδος. Ισχυρίσθηκε ότι με τις πορνογραφικές εικόνες ήθελε να δώσει το έναυσμα για συζήτηση σχετικά με την παιδική πορνογραφία και την ευκολία πρόσβασης στο σχετικό υλικό στο Διαδίκτυο.

Το ΕΔΑΔ απέρριψε την προσφυγή της και έκρινε ότι και οι καλλιτέχνες δεσμεύονται από το άρθρο 10 παρ. 2 ΕΣΔΑ (Η άσκησις τωv ελευθεριώv τoύτωv, συvεπαγoμέvωv καθήκovτα και ευθύvας δύvαται vα υπαχθή εις ωρισμέvας διατυπώσεις, όρoυς, περιoρισμoύς ή κυρώσεις, πρoβλεπoμέvoυς υπό τoυ vόμoυ και απoτελoύvτας αvαγκαία μέτρα εv δημoκρατική κoιvωvία δια τηv εθvικήv ασφάλειαv, τηv εδαφικήv ακεραιότηταv ή δημoσίαv ασφάλειαv, τηv πρoάσπισιv της τάξεως και πρόληψιv τoυ εγκλήματoς, τηv πρoστασίαv της υπoλήψεως ή τωv δικαιωμάτωv τωv τρίτωv, τηv παρεμπόδισιv της κoιvoλoγήσεωςεμπιστευτικώv πληρonoριώv ή τηv διασφάλσισιv τoυ κύρoυς και αμερoληψίας της δικαστικής εξoυσίας. ) Το Δικαστήριο δέχθηκε ότι οι ποινικές διατάξεις με βάση τις οποίες τιμωρήθηκε αποσκοπούν στην προστασία των ηθών και των δικαιωμάτων των άλλων, ιδιαίτερα δε ότι αποσκοπούν στην προστασία των παιδιών από τη σεξουαλική κακοποίηση και την προστασία της ιδιωτικής τους σφαίρας. Παρά δε την αλλαγή των ηθών η απόφαση ήταν εύλογη και ήταν αποτέλεσμα σωστής στάθμισης των αντιτιθέμενων δικαιωμάτων.

Ειδικότερα, το δικαστήριο δέχθηκε:


22. (...) the Court notes that the applicant’s conviction on the basis of Chapter 17, sections 18 and 19, of the Penal Code was intended to protect morals as well as the reputation or rights of others. The domestic courts found that the artistic work in question included hundreds of photographs of teenage girls or otherwise very young women in sexual poses and acts and that the possession and distribution of these pictures were criminalised. Their criminalisation was mainly based on the need to protect children against sexual abuse as well as violation of their privacy but also on moral considerations.
23. The Court recognises that conceptions of sexual morality have changed in recent years. Nevertheless, the Court does not find the view taken by the Finnish courts unreasonable, especially as the present case concerned minors or persons likely to be minors. The domestic courts, especially the District Court which balanced at length the relationship between freedom of expression, on the one hand, and morals and reputation and rights of others, on the other hand, found that the applicant’s freedom of expression did not justify the possession and public display of child pornography.
24. The applicant claimed that she had included the pictures in her work in an attempt to encourage discussion and raise awareness of how wide-spread and easily accessible child pornography was. The Court notes that the domestic courts acknowledged the applicant’s good intentions and therefore did not impose any sanctions on her. However, possessing and distributing sexually obscene pictures depicting children was still an act subject to criminal liability. The Court considers that it does not follow from the applicant’s claim that her conviction did not, in all the circumstances of the case, respond to a genuine social need.
25. In conclusion, in the Court’s opinion the reasons relied on by the domestic courts were both relevant and sufficient to show that the interference complained of was “necessary in a democratic society”. Having regard to all the foregoing factors, and the margin of appreciation afforded to the State in this area, the Court considers that the interference was proportionate to the legitimate aim pursued.
26. Accordingly, the applicant’s application is manifestly ill-founded and must thus be declared inadmissible pursuant to Article 35 §§ 3 and 4 of the Convention.

Ευρωπαϊκό σύστημα παρακολούθησης της χρηματοδότησης της τρομοκρατίας (TFTP)


ΕΥΡΩΠΑΪΚΗ ΕΠΙΤΡΟΠΗ – ΔΕΛΤΙΟ ΤΥΠΟΥ
Η Επιτροπή προτείνει εναλλακτικές δυνατότητες για τη δημιουργία ενός ευρωπαϊκού συστήματος παρακολούθησης της χρηματοδότησης της τρομοκρατίας
Βρυξέλλες, 13 Ιουλίου 2011 – Ανταποκρινόμενη σε αίτημα του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου της Ευρωπαϊκής Ένωσης, η Επιτροπή εξέδωσε σήμερα ανακοίνωση στην οποία περιγράφει τις σημαντικότερες εναλλακτικές δυνατότητες για τη δημιουργία ενός ευρωπαϊκού συστήματος παρακολούθησης της χρηματοδότησης της τρομοκρατίας (TFTP). Η ανακοίνωση αυτή αποτελεί μια πρώτη απόκριση στο αίτημα να καταρτιστεί ένα νομικό και τεχνικό πλαίσιο για τη δημιουργία ενός τέτοιου συστήματος στους κόλπους της Ευρωπαϊκής Ένωσης.

Η Επίτροπος Εσωτερικών Υποθέσεων κα Cecilia Malmström δήλωσε: «Μετά τη σύναψη της συμφωνίας TFTP ΕΕ-ΗΠΑ, το Ευρωπαϊκό Κοινοβούλιο και το Συμβούλιο κάλεσαν την Επιτροπή να προτείνει ευρωπαϊκή λύση για την εξαγωγή των απαιτούμενων δεδομένων σε ευρωπαϊκό έδαφος. Η σημερινή ανακοίνωση περιγράφει τις διάφορες πιθανές εναλλακτικές λύσεις και αποσκοπεί στη δρομολόγηση ενός διαλόγου για ενδεχόμενες προτάσεις που θα υποβληθούν στο μέλλον. Δεδομένου ότι οι προτάσεις αυτές θα πρέπει να σέβονται πλήρως τα θεμελιώδη δικαιώματα, ιδίως δε να εξασφαλίζουν ένα υψηλό επίπεδο προστασίας των δεδομένων, προτίθεμαι να δώσω ιδιαίτερη προσοχή στην αναγκαιότητα και την αναλογικότητα οιωνδήποτε μέσων προταθούν».

Το ευρωπαϊκό TFTS θα πρέπει να έχει δύο κύριους στόχους: πρώτον, το σύστημα πρέπει να συμβάλλει στον περιορισμό του όγκου προσωπικών δεδομένων που διαβιβάζονται στις ΗΠΑ. Δεύτερον, θα πρέπει να συμβάλλει σημαντικά στις προσπάθειες, αφενός, αποκλεισμού των τρομοκρατών από πηγές χρηματοδότησης και υλικά και, αφετέρου, στην παρακολούθηση των οικονομικών τους συναλλαγών.

Η ανακοίνωση περιλαμβάνει σαφείς ενδείξεις σχετικά με τα βασικά ζητήματα που πρέπει να διευκρινιστούν προτού καταστεί δυνατή η δημιουργία ενός τέτοιου συστήματος. Μεταξύ αυτών περιλαμβάνονται: η ανάγκη να γίνουν απόλυτα σεβαστά τα θεμελιώδη δικαιώματα των ευρωπαίων πολιτών, ζητήματα προστασίας και ασφάλειας των δεδομένων, το επιχειρησιακό πεδίο του συστήματος, καθώς και οι δαπάνες.

Η σημερινή ανακοίνωση εκθέτει τις διάφορες εναλλακτικές δυνατότητες που εξετάζονται κατά το παρόν στάδιο, χωρίς να εκδηλώνει συγκεκριμένες προτιμήσεις. Η Επιτροπή θα συζητήσει τώρα λεπτομερώς τις δυνατότητες αυτές με το Συμβούλιο και το Ευρωπαϊκό Κοινοβούλιο προτού αποφασίσει τα επόμενα βήματα βάσει μιας ενδελεχούς εκτίμησης των επιπτώσεων.

Ιστορικό του φακέλου
Στις 28 Ιουνίου 2010, η Ευρωπαϊκή Ένωση και οι Ηνωμένες Πολιτείες της Αμερικής υπέγραψαν τη συμφωνία για την επεξεργασία και διαβίβαση δεδομένων μηνυμάτων χρηματοοικονομικής φύσεως στο πλαίσιο του Προγράμματος Παρακολούθησης της Χρηματοδότησης της Τρομοκρατίας (Συμφωνία TFTP ΕΕ-ΗΠΑ). Συγχρόνως, το Συμβούλιο της ΕΕ κάλεσε την Ευρωπαϊκή Επιτροπή να υποβάλει, έως την 1η Αυγούστου 2011, πρόταση «νομικού και τεχνικού πλαισίου για την εξαγωγή δεδομένων στο έδαφος της ΕΕ». Έκτοτε, η Επιτροπή εργάστηκε για την ενδεχόμενη θέσπιση ενός τέτοιου συστήματος. Η παρούσα ανακοίνωση αποτελεί το πρώτο βήμα για την υποβολή συγκεκριμένων προτάσεων.

Η ανάπτυξη ενός TFTS εγγράφεται σε ένα ευρύτερο θεματολόγιο για την πρόληψη της τρομοκρατίας και την προστασία των ευρωπαίων πολιτών, όπως προσδιορίζεται στη Στρατηγική εσωτερικής ασφάλειας της ΕΕ που εξέδωσε η Επιτροπή τον Νοέμβριο του 2010 (βλ. IP/10/1535 και MEMO/10/598).

For more than 20 years the Jurix Conference has provided an international forum for academics and practitioners in the field of legal informatics for sharing ideas and experiences on the representation of legal content and its representation in computer systems. We invite submission of original papers on the advanced management of legal information and knowledge (foundations, methods, tools, systems and applications).

The 24th edition of Jurix will be organised by the University of Vienna, Centre for Legal Informatics, and held on December 14th-16th 2011.

The conference proceedings will be published by IOS Press (Amsterdam, Berlin, Oxford, Tokyo, Washington DC) in their series “Frontiers in Artificial Intelligence and Applications” before the Conference.

The JURIX conference has been running annually for over 20 years and provides an international forum for both academics and practitioners in the field of legal informatics to meet and share their research and ideas to advance the field of legal knowledge systems.
