To δικαίωμα στην ψηφιακή λήθη

Μία σημαντική καινοτομία της πρότασης Κανονισμού του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου για την προστασία δεδομένων, ο οποίος πρόκειται να αντικαταστήσει την οδηγία 95/46/ΕΚ για την προστασία των φυσικών προσώπων έναντι της επεξεργασίας δεδομένων προσωπικού χαρακτήρα και για την ελεύθερη κυκλοφορία των δεδομένων αυτών, είναι η εισαγωγή του δικαιώματος στην ψηφιακή λήθη, δηλ. του δικαιώματος των φυσικών πρόσωπων «να λησμονηθούν», σύμφωνα με την ορολογία της πρότασης Κανονισμού (άρθρο 17).

Το δικαίωμα στην ψηφιακή λήθη, το οποίο εισάγεται με την πρόταση Κανονισμού, έχει ιδιαίτερη σημασία. Στη σύγχρονη τεχνολογική πραγματικότητα είναι σχεδόν αδύνατο να διαγράψει κανείς πλήρως το ψηφιακό του παρελθόν, ιδίως λόγω της διάδοσης μεγάλου όγκου προσωπικών πληροφοριών στο πλαίσιο του συμμετοχικού Διαδικτύου (Web 2.0), στο οποίο οι πληροφορίες των χρηστών του Διαδικτύου είναι ευρέως και διαρκώς διαθέσιμες, με αποτέλεσμα να χάνουν τον έλεγχο οι χρήστες επί των πληροφοριών που τους αφορούν.


Στην ψηφιακή εποχή προβάλλει ως απαραίτητο ένα νέο δικαίωμα, το δικαίωμα του πρόσωπου να λησμονηθεί, το οποίο έχει ως περιεχόμενο την αμετάκλητη διαγραφή των προσωπικών τους δεδομένων. Σύμφωνα με την Επιτροπή της ΕΕ, το δικαίωμα αυτό συνίσταται στη δυνατότητα των φυσικών πρόσωπων να ζητήσουν τα δεδομένα που τους αφορούν να μην υποβάλλονται σε επεξεργασία και να διαγραφούν όταν δεν είναι πλέον απαραίτητα για νόμιμους σκοπούς .

Στο άρθρο 17 της πρότασης Κανονισμού ρυθμίζεται εξαντλητικά το δικαίωμα της ψηφιακής λήθης. Ειδικότερα, στην παρ. 1 προβλέπονται οι προϋποθέσεις για τη διαγραφή των προσωπικών δεδομένων και η μη περαιτέρω διάδοσή τους, ιδίως σε σχέση με όσα διατέθηκαν κατά την παιδική ηλικία του, όταν δεν είχε πλήρη επίγνωση των κινδύνων της επεξεργασίας και θέλει αργότερα να τα αφαιρέσει, κυρίως από το Διαδίκτυ . Το ενδιαφερόμενο πρόσωπο πρέπει να επικαλεστεί έναν από τους παρακάτω λόγους:
α) τα δεδομένα δεν είναι πλέον απαραίτητα σε σχέση με τους σκοπούς για τους οποίους συλλέχθηκαν ή υποβλήθηκαν άλλως πως σε επεξεργασία·
β) το πρόσωπο στο οποίο αναφέρονται τα δεδομένα αποσύρει τη συγκατάθεση επί της οποίας βασίζεται η επεξεργασία σύμφωνα με το άρθρο 6 παράγραφος 1 στοιχείο α), ή εάν το χρονικό διάστημα αποθήκευσης για το οποίο παρασχέθηκε συγκατάθεση έληξε, και εάν δεν υπάρχει άλλος νομικός λόγος για την επεξεργασία των δεδομένων·
γ) το πρόσωπο στο οποίο αναφέρονται τα δεδομένα αντιτάσσεται στην επεξεργασία δεδομένων προσωπικού χαρακτήρα δυνάμει του άρθρου 19·
δ) η επεξεργασία των δεδομένων δεν είναι σύμφωνη προς τον παρόντα κανονισμό για άλλους λόγους.

Εξαίρεση από το δικαίωμα διαγραφής προβλέπεται στις εξής περιπτώσεις (παρ. 3):
α) για την άσκηση του δικαιώματος ελευθερίας της έκφρασης, η οποία διενεργείται αποκλειστικά για δημοσιογραφικούς σκοπούς ή για σκοπούς καλλιτεχνικής ή λογοτεχνικής έκφρασης·
β) για λόγους δημόσιου συμφέροντος στον τομέα της δημόσιας υγείας σύμφωνα με το άρθρο 81·
γ) για ιστορικούς και στατιστικούς σκοπούς ή για σκοπούς ιστορικής έρευνας·
δ) για την τήρηση εκ του νόμου υποχρεώσεως διατήρησης των δεδομένων προσωπικού χαρακτήρα την οποία υπέχει ο υπεύθυνος επεξεργασίας·
ε) στις περιπτώσεις της παρ. 4 .

Ιδιαίτερα αποτελεσματικές είναι οι διοικητικές κυρώσεις που προβλέπονται στο άρθρο 7 § 5 στοιχ. γ΄, όπου προβλέπεται ότι η αρχή ελέγχου επιβάλλει πρόστιμο ύψους έως 500.000 ευρώ, ή σε περίπτωση επιχείρησης, έως 1% του ετήσιου παγκόσμιου κύκλου εργασιών της, σε οποιονδήποτε που από δόλο ή αμέλεια δεν συμμορφώνεται προς το δικαίωμα των προσώπων στα οποία αναφέρονται τα δεδομένα να λησμονηθούν ή το δικαίωμα διαγραφής ή δεν θεσπίζει μηχανισμούς ώστε να διασφαλίζεται η τήρηση προθεσμιών ή δεν λαμβάνει όλα τα απαραίτητα μέτρα για να ενημερώσει τρίτους ότι το πρόσωπο στο οποίο αναφέρονται τα δεδομένα ζητεί να διαγραφεί κάθε σύνδεσμος, ή αντίγραφο ή αναπαραγωγή των δεδομένων προσωπικού χαρακτήρα.


Συμπέρασμα: Το δικαίωμα στην ψηφιακή λήθη, όπως κατοχυρώνεται στο άρθρο 17 της πρότασης Κανονισμού είναι ένα ισορροπημένο δικαίωμα, αλλά η πρακτική του εφαρμογή ενέχει πολλές δυσχέρειες, καθώς είναι τεχνικά πολύ δύσκολο να εντοπίσει κανείς όλους τους διαδικτυακούς τόπους, στους οποίους δημοσιεύονται τα προσωπικά δεδομένα των χρηστών και να πετύχει τη διαγραφή τους.

Απόφαση ΔΕΕ C-376/11: Νομιμοποίηση κατόχου αδείας που αφορά προηγούμενα δικαιώματα για την καταχώριση ονόματος χώρου .eu


Απόφαση στην υπόθεση C-376/11 Pie Optiek SPRL κατά Bureau Gevers SA, European Registry for Internet Domains ASBL

Σύμφωνα με το ΔΕΕ, στους κατόχους αδειών που µπορούν να προτείνουν την καταχώριση ενός σήµατος ως ονόµατος τοµέα .eu κατά τη διάρκεια της «Sunrise Period» δεν περιλαµβάνονται και τα πρόσωπα που δεν έχουν εξουσιοδοτηθεί να κάνουν εµπορική χρήση του σήµατος αυτού σύµφωνη µε τις λειτουργίες του σήµατος.

Η καταχώριση των ονοµάτων τοµέα ανωτάτου επιπέδου .eu άρχισε στις 7 ∆εκεµβρίου 2005. Γίνεται σύµφωνα µε την αρχή της απόλυτης χρονικής προτεραιότητας, δηλαδή ο πρώτος αιτών έχει προτεραιότητα. Ωστόσο, κατά τους τέσσερις πρώτους µήνες, περίοδο η οποία συµφωνήθηκε να αποκαλείται «Sunrise Period», µόνον οι κάτοχοι προηγούµενων δικαιωµάτων και οι δηµόσιοι φορείς είχαν το δικαίωµα να ζητήσουν την καταχώριση. Εξάλλου, γινόταν διάκριση µεταξύ των κατόχων προηγούµενων δικαιωµάτων. Συγκεκριµένα, κατά τους δύο πρώτους µήνες την καταχώριση µπορούσαν να ζητήσουν µόνον οι δικαιούχοι εθνικών και κοινοτικών σηµάτων καθώς και γεωγραφικών ενδείξεων. Πάντως, οι κάτοχοι αδειών εκµεταλλεύσεως αυτών των σηµάτων ή ενδείξεων µπορούσαν να επωφεληθούν από την προνοµιακή αυτή µεταχείριση. Κατά την ισχύουσα ρύθµιση, η EURid, αρµόδια για τις καταχωρίσεις αρχή, προβαίνει στην καταχώριση των ονοµάτων τοµέα τα οποία ζητούνται από επιχείρηση εγκατεστηµένη σε κράτος µέλος της Ένωσης.

Η αµερικανική εταιρία Walsh Optical πωλεί µέσω του ιστότοπού της στο ∆ιαδίκτυο φακούς επαφής και άλλα οπτικά είδη. Μερικές εβδοµάδες πριν από την έναρξη της «Sunrise Period» είχε καταχωρίσει το σήµα Μπενελούξ «Lensworld». Εξάλλου, συνήψε «σύµβαση παραχωρήσεως άδειας χρήσεως» µε την Bureau Gevers, βελγική εταιρία η οποία δραστηριοποιείται στην παροχή συµβουλών στον τοµέα της πνευµατικής ιδιοκτησίας. Σύµφωνα µε τη σύµβαση, η Bureau Gevers όφειλε να προβεί στην καταχώριση ονόµατος τοµέα .eu στο όνοµά της µεν, αλλά για λογαριασµό της Walsh Optical. Ως εκ τούτου, στις 7 ∆εκεµβρίου 2005, πρώτη ηµέρα της «Sunrise Period», η Bureau Gevers κατέθεσε το όνοµα τοµέα «lensworld.eu» στην EURid. Στις 10 Ιουλίου 2006, αυτό το όνοµα τοµέα καταχωρίστηκε για την Bureau Gevers.

Η βελγική εταιρία Pie Optiek, η οποία δραστηριοποιείται στην πώληση φακών επαφής, γυαλιών και άλλων οπτικών προϊόντων µέσω του ∆ιαδικτύου, επίσης κατέθεσε, στις 17 Ιανουαρίου 2006, το όνοµα τοµέα «lensworld.eu» στην EURid. Λίγο νωρίτερα, είχε επίσης ζητήσει την καταχώριση εικονιστικού σήµατος της Μπενελούξ που περιλαµβάνει το λεκτικό σηµείο «Lensworld». Ωστόσο, η EURid απέρριψε την αίτηση αυτή λόγω της χρονικής προτεραιότητας της αιτήσεως της Bureau Gevers. Η Pie Optiek υποστηρίζει τώρα ότι η Bureau Gevers ενήργησε για κερδοσκοπικούς λόγους και καταχρηστικώς.

Στο πλαίσιο αυτό, το Cour d’appel de Bruxelles (Βέλγιο), που επιλήφθηκε εφέσεως στη διαφορά αυτή, ζητεί από το ∆ικαστήριο να διευκρινίσει το περιεχόµενο της έννοιας του «κατόχου άδειας που αφορά προηγούµενα δικαιώµατα» δικαιουµένου να ζητήσει την καταχώριση κατά τη διάρκεια της πρώτης φάσεως της «Sunrise Period».
Καταρχάς, το ∆ικαστήριο διαπιστώνει ότι ο όρος «κάτοχος άδειας» δεν ορίζεται από το δίκαιο της Ένωσης. Στο πλαίσιο αυτό, το ∆ικαστήριο υπενθυµίζει ότι ο τοµέας ανωτάτου επιπέδου .eu δηµιουργήθηκε προκειµένου να αποκτήσει η εσωτερική αγορά µεγαλύτερη προβολή στην εικονική αγορά η οποία βασίζεται στο ∆ιαδίκτυο, παρέχοντας µια σαφώς αναγνωρίσιµη σύνδεση µε την Ένωση, καθώς και επιτρέποντας στις επιχειρήσεις, στους οργανισµούς και στα φυσικά πρόσωπα εντός της Ένωσης να προβαίνουν σε καταχωρίσεις σε έναν ειδικό τοµέα ο οποίος θα καθιστά την εν λόγω σύνδεση εµφανή.

Βάσει αυτού του σκοπού, καταχωρίζονται στον τοµέα ανωτάτου επιπέδου .eu τα ονόµατα τοµέα που ζητούνται από οποιαδήποτε επιχείρηση η οποία έχει την καταστατική της έδρα, την κεντρική της διοίκηση ή την κύρια εγκατάστασή της εντός της Ένωσης, από οποιονδήποτε οργανισµό ο οποίος είναι εγκατεστηµένος εντός της Ένωσης, υπό την επιφύλαξη του εφαρµοστέου εθνικού δικαίου, καθώς και από οποιοδήποτε φυσικό πρόσωπο που είναι κάτοικος της Ένωσης. Οι εν λόγω επιχειρήσεις, οργανισµοί και φυσικά πρόσωπα αποτελούν επιλέξιµα µέρη δυνάµενα να καταχωρίσουν ένα ή πλείονα ονόµατα τοµέα στον τοµέα .eu. Όσον αφορά τους κατόχους προηγούµενων δικαιωµάτων, µόνον όσοι έχουν την καταστατική τους έδρα, την κεντρική τους διοίκηση, την κύρια εγκατάστασή τους ή την κατοικία τους εντός της Ένωσης είναι επιλέξιµοι να ζητήσουν την καταχώριση, κατά τη διάρκεια της «Sunrise Period», ενός ή πλειόνων ονοµάτων τοµέα στον τοµέα ανωτάτου επιπέδου .eu. Οµοίως, οι κάτοχοι αδειών που αφορούν προηγούµενα δικαιώµατα είναι επιλέξιµοι µόνον αν αναποκρίνονται στο κριτήριο της παρουσίας στο έδαφος της Ένωσης και να διαθέτουν, στη θέση του δικαιούχου, τουλάχιστον εν µέρει ή/και προσκαίρως, το επίµαχο προηγούµενο δικαίωµα.

Πράγµατι, θα αντέβαινε στους σκοπούς της οικείας ρυθµίσεως η παροχή, σε δικαιούχο προηγούµενου δικαιώµατος ο οποίος δεν ανταποκρίνεται στο κριτήριο της παρουσίας στο έδαφος της Ένωσης, της δυνατότητας να ζητήσει την καταχώριση τοµέα .eu µέσω προσώπου που ανταποκρίνεται µεν σε αυτό το κριτήριο παρουσίας αλλά δεν διαθέτει, έστω και εν µέρει ή προσκαίρως, το εν λόγω δικαίωµα.

Εξάλλου, το ∆ικαστήριο κρίνει ότι µια σύµβαση µε την οποία ο αντισυµβαλλόµενος, που καλείται «κάτοχος άδειας», υποχρεούται, έναντι αµοιβής, να καταβάλει εύλογες προσπάθειες ώστε να καταθέσει αίτηση και να επιτύχει την καταχώριση ενός ονόµατος τοµέα .eu, για τον δικαιούχο σήµατος προσοµοιάζει περισσότερο σε σύµβαση παροχής υπηρεσιών παρά σε σύµβαση παραχωρήσεως άδειας χρήσεως. Αυτό ισχύει κατά µείζονα λόγο όταν η σύµβαση δεν παρέχει στον εν λόγω κάτοχο άδειας κανένα δικαίωµα να χρησιµοποιεί εµπορικώς το σήµα αυτό.

Εποµένως, µια τέτοια σύµβαση δεν µπορεί να θεωρηθεί ως σύµβαση παραχωρήσεως άδειας εκµεταλλεύσεως κατά το δίκαιο των σηµάτων. Ως εκ τούτου, ο αντισυµβαλλόµενος που έχει ως αποστολή την καταχώριση ενός ονόµατος τοµέα .eu για τον δικαιούχο του επίµαχου σήµατος δεν µπορεί να χαρακτηριστεί ως «κάτοχος άδειας που αφορά προηγούµενα δικαιώµατα» κατά την έννοια της ισχύουσας ρυθµίσεως.

Call for Papers:

The digital economy is a technology mediated economy. Computer programs create, store, replicate and distribute its main commodity, digital objects of various kinds. Copyright law has taken on particular significance in this economy, protecting the investment of companies and creators, incentivising innovation and creativity, and ultimately becoming the central element that regulates the relation between the stakeholders in this economy. Ever since Larry Lessig’s proposal to understand “Digital Rights Management” as a form of regulation through
code, the field of copyright in the digital economy has opened up a new field of research questions for Artificial Intelligence and Law. How can we represent in more intelligent and semantically richer ways legal concepts that ensure that all, and only, lawful use can be made of digital objects such as film clips or music tunes? How can Information Retrieval support e-discovery in IP litigation? How can we support through technology creators and digital businesses to manage their IP
rights, or to use third party material in a law-compliant way? These are just a few of the questions that offer new and exciting applications for artificial intelligence in a legal context.

Despite this obvious opportunity for AI and Law research to contribute to the open problem of the adequate regulation of the digital economy, papers with a focus on IP law have been the exception in the AI and law community. The first workshop an AI and IP aims to address this issue, by inviting researchers with background in law or AI to exchange ideas, develop new research programmes and ultimately to form a new community of experts. For the first workshop, we invite papers on topics such as
- “intelligent” DRM systems and copyright regulation through computer code.
- formal models of copyright law and legislation.
- e-discovery for IP litigation.
- decision support systems for IP law.
- intelligent compliance support systems for copyright protected assets.
- intelligent software supported mediation support for IP disputes

EU Case Law on Software Protection






A body of case law of the CJEU is being developed that relates to software protection. In this post, we 'll bring you updates about the jurisprudence of the Court on relevant issues.

1. Case C-128/11 - UsedSoft GmbH v Oracle International Corp.

Abstract: An author of software cannot oppose the resale of his ‘used’ licences allowing the use of his programs downloaded from the internet. The exclusive right of distribution of a copy of a computer program covered by such a licence is exhausted on its first sale. Whether that action can be classified as exhausting the rightholder's distribution right with regard to the copies downloaded - Marketing of 'used' licences of programs downloaded by the first acquirer - Concept of 'lawful acquirer.


Operative part of the judgment

a. Article 4(2) of Directive 2009/24/EC of the European Parliament and of the Council of 23 April 2009 on the legal protection of computer programs must be interpreted as meaning that the right of distribution of a copy of a computer program is exhausted if the copyright holder who has authorised, even free of charge, the downloading of that copy from the internet onto a data carrier has also conferred, in return for payment of a fee intended to enable him to obtain a remuneration corresponding to the economic value of the copy of the work of which he is the proprietor, a right to use that copy for an unlimited period.

b. Articles 4(2) and 5(1) of Directive 2009/24 must be interpreted as meaning that, in the event of the resale of a user licence entailing the resale of a copy of a computer program downloaded from the copyright holder's website, that licence having originally been granted by that rightholder to the first acquirer for an unlimited period in return for payment of a fee intended to enable the rightholder to obtain a remuneration corresponding to the economic value of that copy of his work, the second acquirer of the licence, as well as any subsequent acquirer of it, will be able to rely on the exhaustion of the distribution right under Article 4(2) of that directive, and hence be regarded as lawful acquirers of a copy of a computer program within the meaning of Article 5(1) of that directive and benefit from the right of reproduction provided for in that provision.

Operative part of the judgment
a. Article 1(2) of Council Directive 91/250/EEC of 14 May 1991 on the legal protection of computer programs must be interpreted as meaning that neither the functionality of a computer program nor the programming language and the format of data files used in a computer program in order to exploit certain of its functions constitute a form of expression of that program and, as such, are not protected by copyright in computer programs for the purposes of that directive.

b. Article 5(3) of Directive 91/250 must be interpreted as meaning that a person who has obtained a copy of a computer program under a licence is entitled, without the authorisation of the owner of the copyright, to observe, study or test the functioning of that program so as to determine the ideas and principles which underlie any element of the program, in the case where that person carries out acts covered by that licence and acts of loading and running necessary for the use of the computer program, and on condition that that person does not infringe the exclusive rights of the owner of the copyright in that program.

c. Article 2(a) of Directive 2001/29/EC of the European Parliament and of the Council of 22 May 2001 on the harmonisation of certain aspects of copyright and related rights in the information society must be interpreted as meaning that the reproduction, in a computer program or a user manual for that program, of certain elements described in the user manual for another computer program protected by copyright is capable of constituting an infringement of the copyright in the latter manual if – this being a matter for the national court to ascertain – that reproduction constitutes the expression of the intellectual creation of the author of the user manual for the computer program protected by copyright.



3. Case C‑393/09,Bezpečnostní softwarová asociace – Svaz softwarové ochrany

Operative part of the judgement:

a. A graphic user interface is not a form of expression of a computer program within the meaning of Article 1(2) of Council Directive 91/250/EEC of 14 May 1991 on the legal protection of computer programs and cannot be protected by copyright as a computer program under that directive. Nevertheless, such an interface can be protected by copyright as a work by Directive 2001/29/EC of the European Parliament and of the Council of 22 May 2001 on the harmonisation of certain aspects of copyright and related rights in the information society if that interface is its author’s own intellectual creation.

b. Television broadcasting of a graphic user interface does not constitute communication to the public of a work protected by copyright within the meaning of Article 3(1) of Directive 2001/29.

The Court confirmed the legality of the Decision and fine imposed by the
Commission on Microsoft for abuse of a dominant position in relation to the
refusal to supply the interoperability information for operating PC Windows
with other systems and the tied sale of Windows Media Player.

The Commission had adopted a Decision stating that Microsoft had infringed Article 82 EC by committing abuses of a dominant position because it had engaged in two kinds of abusive conduct, first the refusal by Microsoft to supply its competitors with “interoperability information” and to authorise the use of that information for the purpose of developing and distributing products competing with Microsoft’s own products on the work group server operating systems market, and second by making the availability of the Windows client PC operating system conditional on the simultaneous acquisition of the Windows Media Player software, the consequence of which is the restriction of competition in the multimedia player market. The
Commission imposed a fine of EUR 497 million on Microsoft, as well as corrective
action to be taken within a certain period of time, subject to a complex verification mechanism.

Microsoft brought proceedings for annulment of this Decision before the Court of First Instance, invoking several arguments including errors of assessment by the
Commission, the infringement of rules on the protection of intellectual property rights and the infringement of the principle of proportionality. Microsoft also asked, in the alternative, for a reduction of the fine.
In its judgment, the Court rejected Microsoft’s applications and confirmed the
Commission’s 2004 Decision, in particular with respect to the abuses of a dominant
position and the fine handed down.

Only one minor aspect of this Decision was annulled, namely the imposition of a
monitoring trustee with investigation powers with respect to Microsoft, in the context of the mechanism introduced to monitor the introduction of the corrective measures imposed on the company, as well as payment by Microsoft of the costs associated with this monitoring trustee. In fact, the Court considered that the Commission is thus delegating to the monitoring trustee excessive powers of investigation which the Commission alone can exercise pursuant to Community law.
This judgment is not being appealed against by Microsoft, which has in fact abandoned its other claims before the Court in cases relating to the one at issue.






6. T-19/07 - Systran and Systran Luxembourg v Commission

The General Court orders the Commission to pay Systran liquidated damages of
€12 001 000. The Commission infringed the copyright and know-how held by the Systran group in the Unix version of the Systran machine translation software.

On 4 October 2003 the Commission published a call for tenders for the maintenance and linguistic enhancement of its machine translation system. Following that call for tenders, Systran – the parent company of Systran Luxembourg – contacted
the Commission to inform it that the planned work appeared likely to infringe its intellectual property rights. After correspondence between Systran and the Commission, the latter took the view that Systran had not produced ‘probative documents’ capable of establishing the rights which Systran might claim in respect of its EC-Systran Unix machine translation system. The Commission therefore considered that the Systran group had no right to object to the work carried out by the company which had been successful in the call for tenders. Considering that, after the award of the tender contract, the Commission had unlawfully disclosed its know-how to a third party and that the Commission was infringing its copyright when unauthorised development of the EC-Systran Unix version was carried out by the successful contractor, Systran and Systran Luxembourg brought an action for damages against the Commission before the General Court.

Since the parties could not reach any agreement to resolve the matter when invited by the General Court following the hearing to attempt conciliation, the General Court now gives its ruling on the action for damages. The General Court states, first, that the dispute concerns non-contractual liability. The contracts entered into in the past by the Commission to enable it to use the Systran software do not deal with questions of disclosure of Systran’s know-how to a third party or the carrying out of work which might infringe the intellectual property rights of that company.

As regards the unlawfulness of the Commission’s alleged conduct, the General Court considers that the Systran group has established that there is a substantial similarity, in the core material and certain linguistic routines (programmes), between the Systran Unix and EC-Systran Unix versions, and that the Systran group can therefore rely on the rights held in the Systran Unix version, developed and marketed by Systran since 1993, to object to the disclosure to a third party without its consent of the derivative EC-Systran Unix version, adapted by Systran Luxembourg from 1997 onwards to meet the needs of the Commission.

Call for Papers: Online Privacy: Consenting to your Future

Call For papers:
The internet has provided individuals with a virtually unlimited choice for communication and content-sharing services. The social network and user-generated content services (SNS/UGC) get users to quickly connect to wider networks, providing certain personal details and agreement to terms of service. However, when consent can be given as fast as a click of the mouse, the question arises are to whether this remains an effective and fair way of protecting the individual. Do individuals understand the agreements into which they are entering? Is the law adequate and effective in its current state?

With new legislative and policy instruments proposed for data processing in Europe and beyond, the focus turns to what sort of environment consumers, service providers and policy-makers envision for the future. What form of relationship do users want with the services they use? Will new proposals help in creating this relationship?

The CONSENT project, financed by the EU Commission under the FP7 Program, addresses these and other related questions and issues through a comprehensive and scientific approach which combines quantitative and qualitative research on the awareness and perceptions of consumers with a review of existing legislation to produce guidelines as well as a toolkit which could inform system designers, policy makers and legislative bodies across Europe and beyond.

The Online Privacy: Consenting to your Future conference brings together experts from different perspectives (policy makers, academia, industry and citizen groups) to share experience and knowledge as well as to discuss risks and opportunities inherent to the growth of UGC/SNS on the Internet. The Online Privacy: Consenting to Your Future Conference will include invited speakers, reports of the research covered in the CONSENT Project as well as peer-reviewed studies received in response to this Call for Papers.

Draft Regulation "on electronic identification and trusted services for electronic transactions in the internal market"


On 04.06.2012 the EU Commission submitted a Proposal for a REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL on electronic identification and trust services for electronic transactions in the internal market (COM(2012) 238 final).

The proposal will now go through the ordinary legislative procedure for its adoption by co-decision of the European Parliament and the Council. The new framework for electronic identification and electronic trust services will: ensure mutual recognition and acceptance of electronic identification across borders; give legal effect and mutual recognition to trust services including enhancing current rules on e-signatures and providing a legal framework for electronic seals, time stamping, electronic document acceptability, electronic delivery and website authentication. This proposal represents the first milestone in the implementation of the objectives of the Legislation Team (eIDAS) Task Force set up by the Commission in order to to deliver a predictable regulatory environment for electronic identification and trust services for electronic transactions in the internal market to boost the user convenience, trust and confidence in the digital world (See Digital Agenda).

The proposal fully respects both existing national ID systems and the preferences of those Member States without national ID schemes. It allows countries with e-ID to opt-in or to remain outside of the European scheme. Once a Member State notifies that they wish to join the pan-European scheme, they must offer the same access to public services via e-ID that they offer to their own citizens.

European Commission Vice President Neelie Kroes said "People and businesses should be able to transact within a borderless Digital Single Market, that is the value of Internet. Legal certainty and trust is also essential, so a more comprehensive eSignatures and eIdentification Regulation is needed."

"This proposal will mean you can make the most of your e-ID, if you have one. With mutual recognition of national e-IDs and common standards for trust services and eSignatures, we can prevent a national carve-up of the Internet and online public services and make life easier for millions of businesses and even more citizens. "

The proposed Regulation will not:

oblige EU Member States to introduce, or individuals to obtain, national identity cards, electronic identity cards or other eID solutions,
introduce a European eID or any kind of European database,
enable or require the sharing of personal information with other parties.
Key beneficiaries of the various aspects of the Regulation will include:

Students who could register for a foreign university online, rather than having to travel abroad to complete the paper work in person.
Citizens arranging a move to another EU country or a marriage abroad or filing multiple tax returns.
Patients needing medical assistance abroad could securely check or authorise a doctor to access their online medical records.

Companies could tender online for public sector contracts anywhere in the EU. They could sign, time stamp and seal their bids electronically instead of printing and sending multiple paper copies of the bids by courier.
People wanting to do business in another EU country could set up a company through the Internet and submit annual reports online, with ease.
Governments could reduce administrative burdens and increase efficiency, better serving their citizens and saving taxpayers' money.


Background
Both elements of the Regulation – e-ID and eSignatures - will create a predictable regulatory environment to enable secure and seamless electronic interactions between businesses, citizens and public authorities. This will increase the effectiveness of public and private online services, eBusiness and electronic commerce in the EU.

The approach to eSignatures, which builds on the current eSignature Directive (Directive 1999/93/EC), has brought a degree of harmonisation to practices across Europe. All countries in the EU have legal frameworks for eSignatures, however these diverge and make it de facto impossible to conduct cross border electronic transactions. The same holds true for trust services like time stamping, electronic seals and delivery, and website authentication, which lack European interoperability. Therefore, this Regulation proposes common rules and practices for these services.

For e-ID the Regulation provides for the legal certainty by the mutual recognition and acceptance principle in which Member States accept national e-IDs which have been officially notified to the Commission. It is not obligatory for Member States to register their national eIDs, but the Commission hopes that many Member States will chose to do this.

The Commission and EU Member States have proven that cross border mutual recognition of eIdentification works, through the STORK project involving 17 Member States

Privacy and Emerging Technologies

A universal feature of modern public life is the invasion of privacy that occurs every day and in a variety of forms. Invasive surveillance activities are carried out in the name of preventing terrorism and stopping fraud. Crime control has become synonymous with surveillance technologies, information technologies and databases. The boundaries of public and private life have become blurred, and privacy has become compromised in the name of protecting the public. At the same time, users of social networks and Web 2.0 services voluntarily give away their information – supposedly to other users, but whether they know it or not, they are also giving it to companies and whoever is interested in the data freely available on the Web. Google and Facebook’s power are being discussed more and more in the media, opening up a discourse about companies and citizens’ handling of personal information.

Despite numerous legislative frameworks designed to protect privacy, rapid technological advances in various technological fields (the Internet, surveillance, biometrics, genomics, neurotechnology) have meant that the law often falls behind technological developments. Legislation is frequently designed as principles, rather than to fit specific technologies. Furthermore, the extent to which legislation is enforced or is enforceable varies.

The idea of a right to privacy has been a long-debated issue. For some, privacy protection can only occur through the development of transparent standards; for others, privacy is already an outdated concept. Attempts to ensure privacy protection have focused on “data” and legal frameworks. More recently, privacy-enhancing technologies have become an important technological advance, although they have not been widely adopted by the online community. It is widely acknowledged that existing legal frameworks fall short in terms of impacting on organisational practices. The question then arises: how can privacy be protected in the future and how can the protection keep up with the dynamic technological developments?

In recent years, we have seen attempts to design a process that will allow the assessment and management of possible ethical and privacy risks. The core elements in this process are “privacy and ethical impact assessments” as a tool to systematically identify the risks of scientific developments and emerging technologies in their early stages. The other element is “privacy by design”, so far practically still an under defined concept to take the non-technical requirements for privacy into account already at the beginning of a development cycle. This has to be embedded in a future methodology for risk management.

The EC-funded PRESCIENT project is hosting an international conference in Berlin to provide a forum for the discussion of new approaches to assess the ethical and privacy impacts of emerging technologies. New approach need to be more clearly specified and informed by current research on privacy, data protection, innovation and foresight studies.

Νομική Πληροφορική: H εφαρμογή των τεχνολογιών πληροφορικής και επικοινωνιών στη νομική πράξη

Το βιβλίο ξεκινά με τη διαπίστωση ότι οι νέες τεχνολογίες της πληροφορικής και των επικοινωνιών (ΤΠΕ) επιφέρουν ραγδαίες αλλαγές στο περιβάλλον και τον τρόπο εργασίας των νομικών. Περαιτέρω, σημειώνεται ότι το δίκαιο υπόκειται σε μετασχηματισμό τόσο ως κοινωνικός θεσμός όσο και ως αντικείμενο επαγγελματικής ενασχόλησης και για το λόγο αυτό καθίσταται αναγκαία η κατανόηση του εν λόγω μετασχηματισμού. Αντικείμενο ακριβώς του βιβλίου είναι η έρευνα σχετικά με τις βαθιές αλλαγές που επιφέρουν οι ΤΠΕ στη νομική επιστήμη.

Σήμερα, η εύρεση της νομοθεσίας και νομολογίας λαμβάνει χώρα ταχύτατα και με χαμηλό κόστος, με τη χρήση επιγραμμικών (online) βάσεων δεδομένων και άλλων συστημάτων νομικής πληροφόρησης. Την πληροφόρηση αυτή αξιοποιούν οι νομικοί (δικηγόροι, δικαστές, συμβολαιογράφοι) και οι νομοθέτες, αλλά και τρίτοι, οι οποίοι είναι αποδέκτες της νομικής πληροφορίας, όπως είναι, π.χ., τα στελέχη επιχειρήσεων, δημόσιων υπηρεσιών, ΟΤΑ και άλλοι επαγγελματίες.

Τις μεθόδους πρόσβασης και επεξεργασίας της νομικής πληροφορίας μελετά ο κλάδος της νομικής πληροφορικής, με στόχο την ορθολογικότερη και αποτελεσματικότερη οργάνωση και λειτουργία του νομικού συστήματος και της νομικής επιστήμης. Στα ζητήματα αυτά επικεντρώνεται η ανά χείρας μελέτη. Μετά από μια εκτενή εισαγωγή στα θεωρητικά ζητήματα που ανακύπτουν από την εφαρμογή των ΤΠΕ στο δίκαιο, παρουσιάζονται στο επόμενο κεφάλαιο οι τεχνολογίες νομικής πληροφόρησης, όπως είναι ιδίως, οι νομικές βάσεις δεδομένων και οι τεχνικές αναζήτησης πληροφοριών σε αυτές. Γίνεται αναφορά τόσο στις ελληνικές όσο και στις κοινοτικές και διεθνείς νομικές βάσεις δεδομένων, τις οποίες μπορεί να χρησιμοποιήσει ο Έλληνας νομικός.

Στη συνέχεια παρουσιάζονται οι τεχνολογίες του Διαδικτύου και ειδικότερα, εκτίθενται οι δυνατότητες που παρέχει το Διαδίκτυο για την προβολή και επικοινωνία του σύγχρονου νομικού. Στο βιβλίο παρέχονται χρήσιμες διευθύνσεις δικτυακών τόπων που παρέχουν νομική πληροφόρηση, ενώ γίνεται αναφορά στις νέες τεχνολογίες του Διαδικτύου, όπως είναι το σημασιολογικό Διαδίκτυο, η γλώσσα σήμανσης XML κοκ αλλά και στη νομική διδασκαλία μέσω του Διαδικτύου. Το τελευταίο κεφάλαιο παρουσιάζει τρία κεντρικά θέματα που αφορούν τις εφαρμογές των ΤΠΕ στην παραγωγή και εφαρμογή του δικαίου και πιο συγκεκριμένα, τα νομοθετικά πληροφοριακά συστήματα, την ηλεκτρονική διακυβέρνηση και την ηλεκτρονική δίκη.

Θα πρέπει να σημειωθεί ότι στο βιβλίο δεν γίνεται απλά περιγραφή των τεχνολογιών νομικής πληροφορικής, αλλά επιχειρείται η συστηματική ανάλυση και κριτική προσέγγιση των εφαρμογών των ΤΠΕ στο δίκαιο, καθώς και η διερεύνηση των ορίων εφαρμογής τους. Επιπλέον, λόγω του ότι το παρόν βιβλίο απευθύνεται σε νομικούς, εκτίθεται σε αυτό το νομικό πλαίσιο – όπου αυτό υφίσταται – που διέπει τη χρήση των ΤΠΕ από νομικούς, όπως λ.χ. στην περίπτωση της διαφήμισης των δικηγόρων στο Διαδίκτυο ή της ηλεκτρονικής δίκης και της ηλεκτρονικής δημόσιας διοίκησης κ.ο.κ.

On-line public consultation on "specific aspects of transparency, traffic management and switching in an Open Internet"


The European Commission opened up a public consultation on open network issues. In particular, it is seeking answers to questions on specific aspects of transparency, traffic management and switching in an Open Internet.

Purpose of the consultation


This public consultation seeks responses to specific questions on transparency, switching and certain aspects of traffic management which emerged as key issues in the net neutrality debate that has taken place in Europe over the past years.

The EU regulatory framework for electronic communications as reviewed in 2009 enshrines as a policy objective the end-users' ability to access and distribute information or run applications and services of their choice. It also modernises the provisions regarding ease of switching, transparency and quality of service, and gives National Regulatory Authorities (NRAs) tools to deal with net neutrality issues. Under the Universal Service Directive, NRAs dispose of a competence to set minimum quality of service requirements and are also empowered to settle disputes between market players.

The Commission launched a broad public consultation on 'The open Internet and net neutrality in Europe' in summer 2010 followed by a joint summit with the European Parliament in November 2010. In April 2011 the Commission adopted its Communication 'The open Internet and net neutrality in Europe' (1), and on 29 May 2012 the Body of European Regulators of Electronic Communications (BEREC) published the results of its traffic management investigation (2) undertaken upon the Commission's request. In addition, BEREC has looked into quality of service (3), transparency (4), competition issues (5) and IP interconnection (6) in the context of net neutrality. BEREC further issued a report on best practices to facilitate consumer switching (7), where it concluded that for competition to be able to deliver effective outcomes for consumers it was essential to ensure transparency for consumers and called inter alia for a minimisation of unnecessary switching costs and barriers.

The BEREC Traffic Management Investigation results provide a good overview of traffic management practices in Europe. The most frequently reported restrictions are the blocking and/or throttling of peer-to-peer (P2P) traffic, on both fixed and mobile networks, and the blocking of VoIP (Internet telephony) traffic on mobile networks. Over 400 operators participated in the investigation which showed that at least 20% of all Internet users, and potentially up to half of EU mobile broadband users, have contracts that allow their Internet service provider (ISP) to restrict services like VoIP or P2P. According to the BEREC report among those fixed and mobile operators with contractual restrictions on P2P 96% and 88%, respectively, enforce them technically. Contractual restrictions on VoIP are technically enforced by more than half (56%) of the mobile operators with such restrictions in their contracts.

In the light of the BEREC results, the Commission concluded that the problems identified warrant targeted action to safeguard and empower consumers. Moreover, all market players need more regulatory certainty to promote the efficient use of networks, infrastructure investments and the development of new business models. The Commission considers regulatory intervention in competitive markets as inappropriate unless it is the only way to solve problems. In a competitive environment consumers are able to change their operator if the latter does not provide the wanted services or restricts their Internet access. For competition to become effective consumers need to be well informed about the characteristics of the services they are offered and they – or at least a sufficient number of them to constrain a given operator - must be able to easily switch between services and service providers.

In order to allow consumers to have access to Internet service offers that truly meet their needs and to enable them to effectively exercise their choices, the Commission is envisaging policy measures addressing the issues of transparency, switching and certain aspects of traffic management, including deep packet inspection (DPI). DPI technologies examine different layers (header and content) of data packets to decide whether a packet may pass or needs to be routed to a different destination. DPI can be used to protect the network and users against malware (viruses etc.) but also to block or slow down other data packets. Union-wide guidance on these issues would avoid diverging approaches in the Member States and a fragmentation of the Digital Single Market.

In view of the previous extensive consultation this consultation focuses on factual information and best practices regarding the relevant issues of transparency, switching and traffic management. The responses from stakeholders are crucial input into the Commission's future actions in this area.

Εφαρμογές δικηγορικών γραφείων για κινητά τηλέφωνα





H διάδοση των «έξυπνων» κινητών τηλεφώνων (smartphones) σε μεγάλο αριθμών συνδρομητών κινητής τηλεφωνίας έχει ως συνέπεια νέες, πρωτόγνωρες δυνατότητες για την προβολή του δικηγορικού γραφείου. Ειδικότερα, οι δικηγορικές εταιρίες και τα δικηγορικά γραφεία μπορούν να αναπτύξουν εφαρμογές (Apps) για κινητά τηλέφωνα διαφόρων προμηθευτών και να κερδίσουν έτσι το κοινό. Τα οφέλη είναι πολλαπλά, καθώς με τη δημιουργία εφαρμογών αυξάνεται η προστιθέμενη αξία του δικηγορικού γραφείου, το οποίο δραστηριοποιείται σε μια καινούργια αγορά και προσελκύει νέους πελάτες, ενώ παράλληλα αυξάνεται ο κύκλος εργασιών και, συνακόλουθα, τα έσοδα του γραφείου.

Ωστόσο, όλα τα δικηγορικά γραφεία και εταιρίες δεν αποδίδουν τη δέουσα σημασία στις κινητές εφαρμογές. Σύμφωνα με μια έρευνα της Κ. Tasso στο Ην. Βασίλειο, πολλά γραφεία δεν έχουν φροντίσει ώστε οι ιστοσελίδες που διαθέτουν να μπορούν να αναγνωστούν από κινητά τηλέφωνα και φορητές συσκευές, όπως λ.χ., Blackberrys, iPhone, iPad και Kindle, ενώ άλλα γραφεία, στην προσπάθεια τους να βρεθούν στην αιχμή της τεχνολογίας δημιούργησαν κακές εφαρμογές για κινητά τηλέφωνα. Ωστόσο, σύμφωνα με την πρόβλεψη της ως άνω συγγραφέως, σε δέκα έτη δεν θα υπάρχει καμία διαφορά μεταξύ πρόσβασης στο Διαδίκτυο από η/υ και από φορητές συσκευές και για αυτό, τα δικηγορικά γραφεία πρέπει να φροντίζουν ώστε τουλάχιστον οι ιστοχώροι που διατηρούν να μπορούν να αναγνωστούν από κινητά τηλέφωνα και φορητές συσκευές.

Βεβαίως, οι κινητές εφαρμογές κοστίζουν αρκετά και δεν υπάρχουν έτοιμες λύσεις για τη δημιουργία τους, ενώ όταν δεν σχεδιάζονται σωστά, λειτουργούν αρνητικά ως προς την εικόνα του δικηγορικού γραφείου.

ΔΕΕ: Νόμιμη η μεταπώληση άδειας χρήσεως προγράμματος η/υ





Το Δικαστήριο της ΕΕ στην απόφαση της 3ης Ιουλίου 2012 (υπόθεση C-128/11, UsedSoft GmbH κατά Oracle) έκρινε ότι είναι νόμιμη η μεταπώληση άδειας χρήσεως προγράμματος η/υ, το οποίο μεταφορτώνει ένας χρήστης από το Διαδίκτυο. Με τη νομολογία αυτή του ΔΕΕ καθίσταται πλέον σαφές ότι είναι δυνατή μεταπώληση τυποποιημένου λογισμικού, ακόμα και αν στην άδεια χρήσης αναφέρεται ότι το δικαίωμα χρήσεως του λογισμικού που παραχωρείται είναι μη εκχωρήσιμο, όπως συμβαίνει κατά κανόνα στις συμβάσεις τυποποιημένου λογισμικού (βλ. Ιγγλεζάκη, Δίκαιο της πληροφορικής, β΄εκδ. (2008), εκδ. Σάκκουλα, σελ 124 επ.).

Το ζήτημα αυτό ήταν ασαφές και ιδίως ήταν ασαφές αν μπορούσε να παραχωρηθεί σε άλλο χρήστη λογισμικό από το Διαδίκτυο. Η απόφαση αυτή αναμένεται να απασχολήσει την επιστήμη του δικαίου και κυρίως τους νομικούς που ασχολούνται με το δίκαιο της πληροφορικής, καθώς ανατρέπει τη συνήθη πρακτική των ρητρών που διατυπώνουν οι εταιρίες πληροφορικής, στην προσπάθειά τους να εμποδίσουν τη μεταπώληση ή δωρεάν διάθεση του λογισμικού από τον έναν χρήστη στον άλλο.

Στη θεωρία επιχειρήθηκε να αντιμετωπισθεί η ρήτρα αυτή με τον έλεγχο καταχρηστικότητας ΓΟΣ, ωστόσο, στην προκειμένη υπόθεση βρίσκει εφαρμογή η διάταξη του άρθρου 4 παρ. 2 της οδηγίας 2009/24 για τη νομική προστασία των προγραμμάτων η/υ, η οποία προβλέπει ότι η "η πρώτη πώληση στην Κοινότητα αντιγράφου ενός προγράμ­ματος ηλεκτρονικού υπολογιστή από τον δικαιούχο του ή με τη συγκατάθεσή του, εξαντλεί το δικαίωμα διανομής του αντιγράφου αυτού εντός της Κοινότητας, εξαιρουμένου του δικαιώματος ελέγ­χου της περαιτέρω εκμίσθωσης του προγράμματος ηλεκτρονικού υπολογιστή ή αντιγράφου του" (βλ. και άρθρο 3 παρ. 1 περ. δ΄, εδ. β΄ν. 2121/1993).

Τα πραγματικά περιστατικά της δίκης έχουν, εν συντομία, ως εξής: Η εταιρία Oracle αναπτύσσει και πωλεί προγράμματα ηλεκτρονικών υπολογιστών. Έχει τα αποκλειστικά δικαιώματα χρήσεως των προγραμμάτων αυτών ως δημιουργός τους βάσει των διατάξεων περί πνευματικής ιδιοκτησίας. Ε Η Oracle πωλεί, στο 85 % των περιπτώσεων, τα επίμαχα στην υπόθεση της κύριας δίκης προγράμματα ηλεκτρονικών υπολογιστών, ήτοι λογισμικό για βάσεις δεδομένων, χρησιμοποιώντας τη δυνατότητα μεταφορτώσεως μέσω του Διαδικτύου. Οι συμβάσεις που συνάπτει η Oracle σε σχέση με τα επίμαχα προγράμματα περιλαμβάνουν, υπό τον τίτλο «Παραχώρηση δικαιώματος χρήσεως», την ακόλουθη ρήτρα: «Η καταβολή του τιμήματος για τις υπηρεσίες εξασφαλίζει, αποκλειστικά προς εξυπηρέτηση της εσωτερικής λειτουργίας της επιχειρήσεώς σας, ένα χρονικώς απεριόριστο, μη αποκλειστικό, μη εκχωρήσιμο, δωρεάν δικαίωμα χρήσεως όλων των προϊόντων που η Oracle αναπτύσσει και θέτει στη διάθεσή σας βάσει της παρούσας συμβάσεως».

Από την άλλη πλευρά, η UsedSoft εμπορεύεται μεταχειρισμένες άδειες για προγράμματα ηλεκτρονικών υπολογιστών, μεταξύ των οποίων και άδειες χρήσεως των επίμαχων στην υπόθεση της κύριας δίκης προγραμμάτων της Oracle. Προς τον σκοπό αυτό, η UsedSoft αγοράζει από πελάτες της Oracle τέτοιες άδειες χρήσεως. Τον Οκτώβριο του 2005, η UsedSoft ανακοίνωσε «ειδική προσφορά για προϊόντα Oracle», στο πλαίσιο της οποίας πρότεινε προς πώληση «ήδη χρησιμοποιημένες» άδειες για τα επίμαχα στην υπόθεση της κύριας δίκης προγράμματα της Oracle.

Η Oracle άσκησε ενώπιον του Landgericht München I αγωγή με αίτημα να παύσει η UsedSoft να εφαρμόζει τις εμπορικές πρακτικές που προαναφέρθηκαν. Το δικαστήριο αυτό έκανε δεκτό το αίτημα της Oracle. Η έφεση της UsedSoft κατά της σχετικής αποφάσεως απορρίφθηκε. Κατόπιν τούτου, η UsedSoft άσκησε αναίρεση ενώπιον του γερμανικού Ακυρωτικού (Bundesgerichtshof.), το οποίο υπέβαλε προδικαστικό ερώτημα προς το ΔΕΕ. Κατά το αιτούν δικαστήριο, οι ενέργειες τόσο της UsedSoft όσο και των πελατών της θίγουν το αποκλειστικό δικαίωμα της Oracle να πραγματοποιεί ή να επιτρέπει είτε τη μόνιμη είτε την προσωρινή αναπαραγωγή των προγραμμάτων της, κατά την έννοια του άρθρου 4, παράγραφος 1, στοιχείο α΄, της οδηγίας 2009/24. Κατά το ίδιο πάντοτε δικαστήριο, οι πελάτες της UsedSoft δεν μπορούν να στηριχθούν, για την αναπαραγωγή των επίμαχων προγραμμάτων, σε δικαίωμα το οποίο τους έχει μεταβιβαστεί εγκύρως από την Oracle. Συγκεκριμένα, από τις συμβάσεις που συνάπτει η Oracle για την παραχώρηση άδειας χρήσεως προκύπτει ότι το δικαίωμα χρήσεως των προγραμμάτων είναι «μη εκχωρήσιμο». Κατά συνέπεια, δεν επιτρέπεται στους πελάτες της Oracle να μεταβιβάσουν σε τρίτους το δικαίωμα αναπαραγωγής των προγραμμάτων αυτών. Το αιτούν δικαστήριο εκτιμά ότι η έκβαση της διαφοράς της κύριας δίκης εξαρτάται από το ζήτημα αν οι πελάτες της UsedSoft μπορούν να επικαλεστούν επιτυχώς το άρθρο 69d, παράγραφος 1, του UrhG, το οποίο μεταφέρει στο γερμανικό δίκαιο το άρθρο 5, παράγραφος 1, της οδηγίας 2009/24 (αφορά την ανάλωση του δικαιώματος διανομής).

Το πρώτο προδικαστικό ερώτημα ήταν αν, και υπό ποιες προϋποθέσεις, η μεταφόρτωση από το Διαδίκτυο, με την άδεια του δικαιούχου, ενός αντιγράφου προγράμματος ηλεκτρονικού υπολογιστή συνεπάγεται ανάλωση του δικαιώματος διανομής του αντιγράφου αυτού εντός της Ευρωπαϊκής Ένωσης, κατά την έννοια του άρθρου 4, παράγραφος 2, της οδηγίας 2009/24.

Το Δικαστήριο κάνει τη διαπίστωση ότι, σε μια περίπτωση όπως αυτή της υποθέσεως της κύριας δίκης, η μεταβίβαση από τον δικαιούχο ενός αντιγράφου προγράμματος ηλεκτρονικού υπολογιστή στον πελάτη, σε συνδυασμό με τη σύναψη, μεταξύ των ίδιων μερών, συμβάσεως για την παραχώρηση άδειας χρήσεώς του, συνιστά «πρώτη πώληση ενός αντιγράφου προγράμματος ηλεκτρονικού υπολογιστή» κατά την έννοια του άρθρου 4, παράγραφος 2, της οδηγίας 2009/24.

Το ΔΕΕ επίσης σημειώνει ότι από οικονομικής απόψεως, η πώληση προγράμματος ηλεκτρονικού υπολογιστή με τη μορφή CD-ROM ή DVD και η πώλησή του μέσω μεταφορτώσεως από το Διαδίκτυο είναι παρεμφερείς. Πράγματι, η διαδικτυακή μετάδοση είναι το λειτουργικό ισοδύναμο της παραδόσεως ενός υλικού φορέα δεδομένων. Η ερμηνεία του άρθρου 4, παράγραφος 2, της οδηγίας 2009/24 υπό το πρίσμα της αρχής της ίσης μεταχειρίσεως επιβεβαιώνει ότι ο προβλεπόμενος στην εν λόγω διάταξη κανόνας της αναλώσεως του δικαιώματος διανομής παράγει αποτελέσματα μετά την πρώτη πώληση ενός αντιγράφου προγράμματος ηλεκτρονικού υπολογιστή εντός της Ένωσης από τον δικαιούχο ή με τη συγκατάθεσή του, ανεξαρτήτως του ζητήματος αν το αντικείμενο της πωλήσεως είναι υλικό ή άυλο αντίγραφο του οικείου προγράμματος.

Η απάντηση που δίδει στο εν λόγω ερώτημα είναι ότι το άρθρο 4, παράγραφος 2, της οδηγίας 2009/24 έχει την έννοια ότι το δικαίωμα διανομής του αντιγράφου ενός προγράμματος ηλεκτρονικού υπολογιστή αναλώνεται εφόσον ο δικαιούχος του δικαιώματος πνευματικής ιδιοκτησίας, ο οποίος επέτρεψε, έστω και δωρεάν, τη μεταφόρτωση του αντιγράφου αυτού από το Διαδίκτυο σε μέσο αποθηκεύσεως δεδομένων, παρέσχε επίσης, έναντι της καταβολής τιμήματος που συμφωνήθηκε προκειμένου να του εξασφαλιστεί αμοιβή αντίστοιχη προς την οικονομική αξία του αντιγράφου του έργου του οποίου είναι κύριος, και χρονικώς απεριόριστο δικαίωμα χρήσεως του εν λόγω αντιγράφου.

Παραπέρα, με το πρώτο και το τρίτο ερώτημα, το αιτούν δικαστήριο ζητεί κατ’ ουσία να διευκρινιστεί αν, και υπό ποιες προϋποθέσεις, ο αγοραστής μεταχειρισμένων αδειών, όπως αυτών που πωλεί η UsedSoft για τη χρήση προγραμμάτων ηλεκτρονικών υπολογιστών, μπορεί, λόγω της επελεύσεως της προβλεπόμενης στο άρθρο 4, παράγραφος 2, της οδηγίας 2009/24 αναλώσεως του δικαιώματος διανομής, να θεωρηθεί «πρόσωπο που απέκτησε νομίμως» κατά την έννοια του άρθρου 5, παράγραφος 1, της οδηγίας 2009/24, με συνέπεια να απολαύει του δικαιώματος αναπαραγωγής του οικείου προγράμματος στο πλαίσιο μιας σύμφωνης προς τον προορισμό του προγράμματος χρησιμοποιήσεώς του.

Η απάντηση που δίδεται είναι ότι τα άρθρα 4, παράγραφος 2, και 5, παράγραφος 1, της οδηγίας 2009/24 έχουν την έννοια ότι, σε περίπτωση που μεταπωλείται άδεια χρήσεως προγράμματος ηλεκτρονικού υπολογιστή, με συνέπεια τη μεταπώληση ενός αντιγράφου του το οποίο είχε μεταφορτωθεί από τον ιστότοπο του δικαιούχου του δικαιώματος πνευματικής ιδιοκτησίας στο Διαδίκτυο, και η ως άνω άδεια είχε παραχωρηθεί στον πρώτο αγοραστή από τον δικαιούχο για χρονικώς απεριόριστη χρήση και έναντι της καταβολής τιμήματος που συμφωνήθηκε προκειμένου να εξασφαλιστεί στον δικαιούχο αμοιβή αντίστοιχη προς την οικονομική αξία του εν λόγω αντιγράφου του έργου του, ο δεύτερος αγοραστής της άδειας αυτής, όπως και κάθε μεταγενέστερος αγοραστής της, μπορούν να επικαλεστούν την προβλεπόμενη στο άρθρο 4, παράγραφος 2, της οδηγίας 2009/24 ανάλωση του δικαιώματος διανομής και, ως εκ τούτου, να θεωρηθούν πρόσωπα που νομίμως απέκτησαν αντίγραφο προγράμματος ηλεκτρονικού υπολογιστή κατά την έννοια του άρθρου 5, παράγραφος 1, της ίδιας οδηγίας, οπότε απολαύουν του δικαιώματος αναπαραγωγής όπως κατοχυρώνεται με την τελευταία αυτή διάταξη.
