IEL Cyber Law Greece


An new update of the monograph Cyberlaw Greece has been recently published by Kluwerlaw International. It is offered as part of the Series International Encyclopaedia of Cyber Law, but it can also be accessed separately online here.

Νέο Περιοδικό jusletter it


Το νέο περιοδικό Jusletter IT είναι ένα πανευρωπαϊκό περιοδικό, όπως δηλώνει και ο τίτλος του, αλλά και το όνομα χώρου του (www.jusletter-it.eu) σε επιγραμμική σύνδεση που αφορά την πληροφορική και το δίκαιο. Το νέο αυτό περιοδικό περιλαμβάνει θεματικές που αφορούν διαφορετικές χώρες, γλώσσες και νομικά ζητήματα.

Το περιοδικό αυτό είναι μπορούμε να πούμε η ψηφιακή πλατφόρμα για τα ζητήματα που αφορούν την πληροφορική και το δίκαιο, περιλαμβάνοντας αρθρογραφία από ειδικούς τέσσερις φορές το χρόνο για τις τελευταίες εξελίξεις και προβληματικές, καθώς και για ειδικά θέματα.

Το Jusletter IT εκδίδεται από τον Erich Schweighofer, Associate Professor, Vienna, AT και τον Franz Kummer, co-owner Weblaw AG, Bern, Switzerland.

Für uns stehen der Mensch und sein Ungerechtigkeitsempfinden im Zentrum der nachfolgenden Betrachtung. Gerechtigkeit sehen wir als einen sekundären Begriff an. Wir weisen nach, dass diese facettenreicher ist als die klassische, auf ARISTOTELES und AQUIN basierte Definition; ferner, dass auch quantitative Aspekte, Maße und Metriken bedeutsam sind. Durch eine Verallgemeinerung des Gleichheitsgedankens gelangen wir zu dem Invarianzprinzip. Mit dessen Hilfe lässt sich die allgemeine kultur- und generationenübergreifende Form der Gerechtigkeit darstellen. Fügt man zu diesem Prinzip noch die eigentliche Dynamik, das Ungerechtigkeitsempfinden und die Wertschätzung des Lebens, hinzu, erhalten wir die Basis für eine Geometrie der Gerechtigkeit.

A Social Interpretation of Possible Worlds

This article sketches some elements of modal logic, on the basis of a logical game which was created by Hughes and Cresswell. Several variants of these games are determined by the different relations of perception among the participants (which «worlds» are represented). It will be discussed, why an obvious variation of the game, in which no self-perception exists, is tacitly omitted by both the authors. A missing variant is added because it just makes it possible to conduct a structural analysis for the important social phenomenon of the acknowledgement relation.

Legal positivism: a self-effacing theory

Legal positivism should be defined by the two theses of the conceptual separation of law and morals and of the social sources of law, the second implying the first. The separation thesis stays and falls with the social sources thesis. According to inclusive legal positivism in a rule of law state the validity of a law may depend on its compatibility with critical morality or ethics. Ethics may be critical of a law, despite all social facts relevant to the validity of such a law. In such a case legal positivism must retire the social sources thesis, because of the way the law is socially understood as ethically justified. So legal positivism remains coherent. It is not self-defeated, but in this case it is self-effacing.

Values and Factors in Legal Balancing

The paper deals with the problem of the relation between factor-based reasoning and teleological reasoning in legal balancing. The basic types of value judgments employed in legal argumentation are identified. The problem of legal balancing is commented upon from the perspective of ideas if corrective and distributive justice. I argue that it is possible to distinguish three functions of factor-based reasoning with regard to legal teleology: approximating function, constraining function and determining function. Several types of argument schemes concerning factors and values are presented and discussed.

Epistemic models for justification and law

The whole epistemological enterprise is thought to be reduced to strict dichotomies of foundationalism versus coherentism. Is this rivalry tenable? In the first part, the paper practices such a distinction with particular reference to theories of law and, by taking the figure of the idealized judge drawn by Dworkin, Hercules, into special account, sketches out some common features of coherence legal theories. In the second part, the paper explores the very general idea of defeasible reasoning as a related avenue of investigation that corresponds to the various difficulties to which foundational and coherence legal theories are exposed.

Some aspects of the evolution of legal norms in the Lower Pleistocene

The research focuses on the relationship between normativity, law, and evolution of culture: legal normativity is represented as a cognitive trait allowing a temporal displacement useful for contemporaneous considerations of temporally detached realities, coupled with the trust in what ought to be. The mix-up between reality and representation in the first cave paintings allowed the hormones that regulate the trusting behavior at the brain level, to increase individual cooperative behaviors, leading to the introduction of egalitarian rules in sharing the prey, stabilizing the cooperation in the group and enabling culture to evolve.

On the Sense of Justice from the Evolutionary Perspective

The analysis of the origins of the sense of justice pursued in the paper revolves around the distinction between the rudimentary and the genuine sense of justice. It is argued that only the rudimentary sense of justice is a biological adaptation; that thereby the genuine sense of justice cannot be explained on purely biological grounds; and that the rudimentary sense of justice is «Janus-faced» – rational-emotional in character, as it is constrained greed plus a bundle of emotions. The paper also presents two ways in which the genuine sense of justice can develop out of its rudimentary form.

The Responsibility to overcome the Question of Guilt

This paper deals with the question of guilt as one important decision factor for modern legal systems. First of all a short look on the Solomonic Judgment will point out the importance of considering a systemic point of view. Then the impacts of the integration of the question of guilt as decision factor for conflict resolutions are highlighted, considering different human relations on different social levels. The question of guilt always becomes a fertilizer of escalation. This will lead back to the modern legal systems and the necessity to overcome the question of guilt, respectively to overcome a personalizing point of view.

The role of the Internet in educational justice

Ηλεκτρονική διεξαγωγή της πολιτικής δίκης


Με το ν. 3994/2011 "Εξορθολογισμός και βελτίωση στην απονομή της πολιτικής δικαιοσύνης και άλλες διατάξεις", με τον οποίο τροποποιείται ο ΚΠολΔ εισάγονται, μεταξύ άλλων, για πρώτη φορά ρυθμίσεις για την ηλεκτρονική διεξαγωγή της δίκης στην πολιτική δίκη. Ο ΚΠολΔ έτσι ακολουθεί το πρότυπο άλλων, αλλοδαπών νομοθεσιών όπως η γερμανική που καθιστούν δυνατή την αξιοποίηση της σύγχρονης τεχνολογίας της πληροφορικής.

Ειδικότερα, θεμελιακή είναι η διάταξη του άρθρου 119 παρ. 4 ΚΠολΔ που ορίζει τα εξής:
Τα δικόγραφα είναι δυνατόν να υποβάλλονται και με ηλεκτρονικά μέσα, εφόσον φέρουν προηγμένη ηλεκτρονική υπογραφή, κατά την έννοια του άρθρου 3 παράγραφος 1 του προεδρικού διατάγματος 150/2001 (Α΄ 125). Το δικόγραφο που έχει υποβληθεί με ηλεκτρονικά μέσα θεωρείται ότι κατατέθηκε, εφόσον επιστραφεί στον αποστολέα του εγγράφου από το δικαστήριο ηλεκτρονική απόδειξη, που θα φέρει προηγμένη ηλεκτρονι-
κή υπογραφή, κατά την άνω έννοια και θα περιέχει και την έκθεση κατάθεσης.

Πιο ειδικά, η δυνατότητα ηλεκτρονικής κατάθεσης προβλέπεται και στο άρθρο 21 παρ. 1 ΚΠολΔ που μεταξύ άλλων προβλέπει ότι "Η κατάθεση του δικογράφου μπορεί να γίνεται και με ηλεκτρονικά μέσα σύμφωνα με την παράγραφο 4 του άρθρου 119", καθώς και ότι "Στη γραμματεία κάθε δικαστηρίου τηρείται και ηλεκτρονικό αρχείο αγωγών".

Πέρα από την ηλεκτρονική κατάθεση της αγωγής γίνεται δυνατή και η ηλεκτρονική επίδοσή της. Το άρθρο 122 παρ. 5 ΚΠολΔ προβλέπει ότι: "Τα δικόγραφα είναι δυνατόν να επιδίδονται, σύμφωνα με την παράγραφο 1, και με ηλεκτρονικά μέσα, εφόσον φέρουν προηγμένη ηλεκτρονική υπογραφή, κατά την έννοια του άρθρου 3 παράγραφος 1 του προεδρικού διατάγματος 150/2001. Το δικόγραφο που έχει επιδοθεί με ηλεκτρονικά μέσα θεωρείται ότι επιδόθηκε, εφόσον επιστραφεί στον αποστολέα του εγγράφου από τον παραλήπτη ηλεκτρονική απόδειξη, που θα φέρει προηγμένη ηλεκτρονική υπογραφή, κατά την άνω έννοια και θα ισχύει ως έκθεση επίδοσης.

Προϋπόθεση έτσι για το υποστατό των διαδικαστικών πράξεων που διενεργούνται με ηλεκτρονικά μέσα είναι η χρήση προηγμένης ηλεκτρονικής υπογραφής. Σύμφωνα με το άρθρο 2 αριθ. 2 π.δ. 150/2001, προηγμένη είναι ηλεκτρονική υπογραφή που πληροί τους εξής όρους: α) συνδέεται µονοσήµαντα µε τον υπογράφοντα, β) είναι ικανή να καθορίσει ειδικά και αποκλειστικά την ταυτότητα του υπογράφοντος, γ) δηµιουργείται µε µέσα τα οποία ο υπογράφων µπορεί να διατηρήσει υπό τον αποκλειστικό του έλεγχο και δ) συνδέεται µε τα δεδοµένα στα οποία αναφέρεται κατά τρόπο, ώστε να µπορεί να εντοπισθεί οποιαδήποτε µεταγενέστερη αλλοίωση των εν λόγω δεδομένων.

Σύμφωνα με τον ορισμό της προηγμένης ηλ. υπογραφής που καθιερώνεται στην παραπάνω διάταξη, η μόνη τεχνολογία ηλ. υπογραφής που πληροί τις προϋποθέσεις του νόμου είναι η ψηφιακή υπογραφή, δηλ. εκείνη η ηλ. υπογραφή που χρησιμοποιεί ασσύμμετρη κρυπτογραφία (βλ. Ιγγλεζάκη, Οι νομικές ρυθμίσεις για τις ψηφιακές υπογραφές. Η οδηγία 1999/93/ΕΚ και οι εθνικές νομοθεσίες, Επισκόπηση Εμπορικού Δικαίου, 2000, σελ. 619 επ., ο ίδιος, Δίκαιο της πληροφορικής, εκδ. Σάκκουλα 2008, αριθ. περιθ. 538 και επ.).

Περαιτέρω, με την παραπομπή στη διάταξη του άρθρου 3 παρ. π.δ. 150/2001 γίνεται σαφές ότι πέρα από την προηγμένη ηλ. υπογραφή θα πρέπει για να είναι έγκυρη η διαδικαστική πράξη να έχει δημιουργεί από ασφαλή διάταξη δημιουργίας υπογραφής και να βασίζεται σε αναγνωρισμένο πιστοποιητικό.

Συνακόλουθα, θα πρέπει οι χρήστες του συστήματος όπως περιγράφεται στο νόμο να κάνουν χρήση υπηρεσιών πιστοποίησης ηλ. υπογραφής και μάλιστα των παρόχων που είναι εγγεγραμμένοι στην ΕΕΤΤ.

Ακόμα, προβλέπεται στο νόμο η εισαγωγή νέων μέσων (multimedia) κατά τη συζήτηση των υποθέσεων από τα δικαστήρια. Συγκεκριμένα, το άρθρο 270 παρ. 7 ΚΠολΔ προβλέπει ότι: "Το δικαστήριο, ύστερα από αίτηση των διαδίκων ή αυτεπαγγέλτως, μπορεί να αποφασίσει oι διάδικοι και οι πληρεξούσιοι δικηγόροι τους κατά τη διάρκεια της συζήτησης να παρίστανται σε άλλο τόπο και να ενεργούν εκεί διαδικαστικές πράξεις. Η συζήτηση αυτή μεταδίδεται ταυτόχρονα με ήχο και εικόνα στην αίθουσα συνεδρίασης του δικαστηρίου και στον τόπο, όπου παρίστανται οι διάδικοι και οι πληρεξούσιοι δικηγόροι τους".

Παρόμοια ισχύουν και για την εξέταση μαρτύρων και πραγματογνωμόνων. Η παρ. 8 του παραπάνω άρθρου ορίζει ότι:

Το δικαστήριο, ύστερα από αίτηση των διαδίκων ή αυτεπαγγέλτως, μπορεί να αποφασίσει την εξέταση μαρτύρων, πραγματογνωμόνων και διαδίκων χωρίς αυτοί να παρίστανται στην αίθουσα συνεδρίασής του, η δε σχετική απόφαση του δικαστηρίου δεν υπόκειται σε ένδικα μέσα. Η εξέταση μεταδίδεται ταυτόχρονα με ήχο και εικόνα στην αίθουσα συνεδρίασης του δικαστηρίου και στον τόπο εξέτασης των μαρτύρων, πραγματογνωμόνων και διαδίκων. Η εξέταση αυτή, η οποία θεωρείται ότι διεξάγεται ενώπιον του δικαστηρίου, έχει την ίδια αποδεικτική ισχύ με την εξέταση στο ακροατήριο.»

Για να ισχύσουν οι παραπάνω διατάξεις προβλέπεται στο άρθρο 72 του νόμου η έκδοση προεδρικού διατάγματος, με το οποίο θα ορίζονται οι ειδικότερες προϋποθέσεις που πρέπει να πληρούνται, καθώς και ο τρόπος με τον οποίο θα γίνεται και θα αποδεικνύεται η με ηλεκτρονικά μέσα κατάθεση της αγωγής, η με ηλεκτρονικά μέσα σύνταξη της έκθεσης κατάθεσης της αγωγής και η τήρηση του ηλεκτρονικού αρχείου αγωγών. Παρόμοια ισχύουν και για τις διατάξεις των παραγράφων 7 και 8 του άρθρου 270 του Κώδικα Πολιτικής Δικονομίας οι λεπτομέρειες εφαρμογής της και ειδικότερα η διεξαγωγή της συζήτησης και η εξέταση προσώπων από το δικαστήριο με τεχνολογικά μέσα, όταν τα πρόσωπα αυτά βρίσκονται εκτός της αίθουσας του δικαστηρίου και σε άλλο τόπο. Αναμένεται επίσης η έκδοση κοινής απόφασης του Υπουργού Οικονομικών και Δικαιοσύνης, Διαφάνειας και Ανθρωπίνων Δικαιωμάτων με την οποία θα προσδιορίζεται ειδικότερα ο τρόπος καταβολής και είσπραξης τελών και ενσήμων για τα δικόγραφα που κατατίθενται και επιδίδονται ηλεκτρονικά.

Ακόμα, αναθεωρείται το δίκαιο της απόδειξης και επαναδιατυπώνεται η διάταξη του άρθρου 444 παρ. 2, η οποία μπορούμε να πούμε ότι αφορά το λεγόμενο "ηλεκτρονικό έγγραφο", που στο ελληνικό δίκαιο νοείται ως μηχανική απεικόνιση.

Ειδικότερα, η εν λόγω διάταξη ορίζει ότι: "Μηχανική απεικόνιση, κατά την έννοια της παραγράφου 1, είναι και κάθε μέσο το οποίο χρησιμοποιείται από υπολογιστή ή περιφερειακή μνήμη υπολογιστή, με ηλεκτρονικό, μαγνητικό ή άλλο τρόπο, για εγγραφή, αποθήκευση, παραγωγή ή αναπαραγωγή στοιχείων, που δεν μπορούν να διαβαστούν άμεσα, όπως επίσης και κάθε μαγνητικό, ηλεκτρονικό ή άλλο υλικό στο οποίο εγγράφεται οποιαδήποτε πληροφορία, εικόνα, σύμβολο ή ήχος, αυτοτελώς ή σε συνδυασμό, εφόσον τα μέσα και τα υλικά αυτά προορίζονται ή είναι πρόσφορα να αποδείξουν γεγονότα που έχουν έννομη σημασία".

Η διάταξη αυτή επαναλαμβάνει τη διατύπωση του άρθρου 13 περ. γ΄ εδαφ. β΄ ΠΚ και η σημασία της είναι πρόδηλη, αφού καθιερώνει ως αποδεικτικό μέσο στην πολιτική δίκη το ηλεκτρονικό έγγραφο, όταν αυτό συγκεντρώνει τις προϋποθέσεις που προβλέπονται για να θεωρηθεί μηχανική απεικόνιση.

Σημειώνεται, ωστόσο, ότι δεν τίθεται ως προϋπόθεση η ύπαρξη ηλεκτρονικής ή προηγμένης ηλεκτρονικής υπογραφής για την αποδεικτική ισχύ ενός εγγράφου, όπως σε άλλα δίκαια. Αυτό ίσως δημιουργήσει προβλήματα στην πράξη, διότι ελλείπει ένας μηχανισμός που να εγγυάται την μη αλλοίωση του περιεχομένου ενός ηλεκτρονικού εγγράφου και θα απαιτείται ασφαλώς η συνδρομή πραγματογνωμόνων σε περίπτωση όπου αμφισβητείται η γνησιότητα μιας μηχανικής απεικόνισης (κατ' ανταπόδειξη).

Γνώμη 13/2011 της ομάδας του άρθρου 29 για τις υπηρεσίες εντοπισμού θέσης σε έξυπνες φορητές συσκευές


Η Ομάδα του άρθρου 29 δημοσίευσε στις 19.5.2011 την υπ' αριθ. 13/2011 Γνώμη σχετικά με τις υπηρεσίες εντοπισμού θέσης σε εφαρμογές "έξυπνων" κινητών (smartphones), ιδίως σε ό,τι αφορά τα λειτουργικά συστήματα για κινητά της Apple και της Google.

Η παραπάνω επιτροπή εμπειρογνωμόνων δέχθηκε ότι, σύμφωνα με τις οδηγίες ΕΕ για την προστασία προσωπικών δεδομένων, πριν από κάθε χρήση δεδομένων θέσης οι χρήστες θα πρέπει να ενημερώνονται ενδελεχώς για την έκταση και το σκοπό της συλλογής δεδομένων και στη συνέχεια να δίνουν τη συγκατάθεσή τους. Παράλληλα, θα πρέπει να μπορούν να ρυθμίζουν τον εντοπισμό της θέσης τους. Οι υπηρεσίες θα πρέπει να προβάλλονται στη συσκευή και ο χρήστης θα πρέπει να μπορεί να διαγράφει όλα τα δεδομένα θέσης από τη συσκευή του.

Οι παροχείς υπηρεσίες δεν θα πρέπει να διατηρούν τις πληροφορίες περισσότερο από όσο είναι αναγκαίο για την εκάστοτε εφαρμογή και σε περίπτωση που αυτές διατηρούνται θα πρέπει να ανωνυμοποιούνται.

Ειδικότερα, τα συμπεράσματα του εγγράφου έχουν ως εξής:

1. Legal framework
• The EU legal framework for the use of geolocation data from smart mobile devices is primarily the data protection directive. Location data from smart mobile devices are personal data. The combination of the unique MAC address and the calculated location of a WiFi access point should be treated as personal data.
• In addition, the revised e-privacy directive 2002/58/EC only applies to the processing of base station data by telecom operators.

2 Controllers
• Three types of controllers can be discerned. They are: controllers of geolocation infrastructure (in particular controllers of mapped WiFi access points); providers of geolocation applications and services and developers of the operating system of smart mobile devices.

3 Legitimate ground
• Because location data from smart mobile devices reveal intimate details about the private life of their owner, the main applicable legitimate ground is prior informed consent.
• Consent cannot be obtained through general terms and conditions.
• Consent must be specific, for the different purposes that data are being processed for, including for example profiling and or behavioural targeting purposes from the controller. If the purposes of the processing change in a material way, the controller must seek renewed specific consent.
• By default, location services must be switched off. A possible opt-out mechanism does not constitute an adequate mechanism to obtain informed user consent.
• Consent is problematic with regard to employees and children. With regard to employees, employers may only adopt this technology when it is demonstrably necessary for a legitimate purpose, and the same goals cannot be achieved with less intrusive means. With regard to children, parents must be judge whether the use of such an application is justified in specific circumstances. At the very least they must inform their children, and, as soon as reasonably possible, allow them to participate in the decision to use such an application.
• The Working Party recommends limiting the scope of consent in terms of time and remind users at least once a year. The Working Party equally recommends sufficient granularity in the consent with regard to the precision of the location data.
• Data subjects must be able to withdraw their consent in a very easy way, without any negative consequences for the use of their device.
• With regard to the mapping of WiFi access points, companies can have a legitimate interest in the necessary collection and processing of the MAC addresses and calculated locations of WiFi access points for the specific purpose of offering geolocation services. The balance of interests between the rights of the controller and the rights of the data subjects requires that the controller offers the right to easily and permanently opt-out from the database, without demanding additional personal data.

4 Information
• Information must be clear, comprehensive, understandable for a broad, nontechnica audience and permanently and easily accessible. The validity of consent is inextricably linked to the quality of the information about the service.
• Third parties like browsers and social networking sites have a key role to fulfill when it comes to the visibility and quality of the information about the processing of geolocation data.

5 Data subject rights
• The different controllers of geolocation information from mobile devices should enable their customers to obtain access to their location data in a human readable format and allow for rectification and erasure without collecting excessive personal data.
• Data subjects also have a right to access, rectify and erase possible profiles based on these location data.
• The Working Party recommends the creation of (secure) online access.

6 Retention periods
• Providers of geolocation applications or services should implement retention policies which ensure that geolocation data, or profiles derived from such data, are deleted after a justified period of time.
• If the developer of the operating system and/or controller of the geolocation infrastructure processes a unique number such as a MAC address or a UDID in
relation to location data, the unique identification number may only be stored for a maximum period of 24 hours, for operational purposes.

Η Επιτροπή παρουσιάζει «οδηγό» για τα δικαιώματα διανοητικής ιδιοκτησίας προς ενίσχυση της δημιουργικότητας και της καινοτομίας



Η Ευρωπαϊκή Επιτροπή δημοσιοποίησε στις 24/5/2011 τη νέα στρατηγική της για τα δικαιώματα διανοητικής ιδιοκτησίας. Στόχος του νέου εκσυγχρονισμένου πλαισίου είναι η ενθάρρυνση της δημιουργικότητας και της καινοτομίας.

Με τις προτάσεις της η Επιτροπή αποσκοπεί να συμβάλλει στην προστασία της βιομηχανικής και πνευματικής ιδιοκτησίας, στη διευκόλυνση της πρόσβασης στα έργα, τα προϊόντα και τις υπηρεσίες και να δημιουργήσει νέες ευκαιρίες για τις επιχειρήσεις. Ο λόγος για τον εκσυγχρονισμό που προωθείται είναι οι τεχνολογικές αλλαγές που έχουν συντελεσθεί και η εντεινόμενη σημασία του Διαδικτύου, το οποίο δημιουργεί ένα νέο περιβάλλον εντός του οποίου τα δικαιώματα διανοητικής ιδιοκτησίας αλλάζουν δραματικά.

Η στρατηγική περιλαμβάνει μια ποικιλία από τις πτυχές του διπλώματος ευρεσιτεχνίας για τη δίωξη των παρανομίων και αυστηρότερα μέτρα κατά της παραποίησης και της πειρατείας. Αυτό γίνεται για να διασφαλιστεί ότι τα δικαιώματα πνευματικής ιδιοκτησίας καλύπτονται πλήρως. Επιπλέον, η Επιτροπή προτείνει ένα σύστημα, καθώς οι χρήστες αποκτούν καλύτερη πρόσβαση στα ορφανά έργα (MEMO/11/333).

Τα δικαιώματα διανοητικής ιδιοκτησίας (ΔΔΙ), τα οποία περιλαμβάνουν διπλώματα ευρεσιτεχνίας, εμπορικά σήματα, σχέδια και γεωγραφικές ενδείξεις, καθώς και τα δικαιώματα πνευματικής ιδιοκτησίας (δικαιώματα δημιουργού) και συγγενικά δικαιώματα (για τους εκτελεστές, παραγωγούς, και ραδιοτηλεοπτικούς σταθμούς), υπάρχουν εδώ και αιώνες. Συχνά, χωρίς καν να το συνειδητοποιούμε, επηρεάζουν την καθημερινή μας ζωή: προστατεύουν την τεχνολογία που χρησιμοποιούμε (αυτοκίνητα, κινητά τηλέφωνα, τρένα), τα τρόφιμα που καταναλώνουμε και τη μουσική που ακούμε ή τις ταινίες βλέπουμε. Αλλά τα τελευταία χρόνια, η τεχνολογική αλλαγή και, ιδιαίτερα, η αυξανόμενη σημασία των διαδικτυακών δραστηριοτήτων έχουν αλλάξει εντελώς τον κόσμο όπου ασκούνται τα ΔΔΙ. Ο υφιστάμενος συνδυασμός των ευρωπαϊκών και εθνικών κανόνων δεν είναι πλέον προσαρμοσμένος στη σημερινή κατάσταση και πρέπει να εκσυγχρονιστεί. Αυτός είναι ο λόγος για τον οποίο η Επιτροπή υιοθέτησε σήμερα ολοκληρωμένη στρατηγική για τον εκσυγχρονισμό του νομικού πλαισίου που εφαρμόζεται στα ΔΔΙ. Στόχος μας είναι να μπορούν οι εφευρέτες, οι δημιουργοί, οι χρήστες και οι καταναλωτές να προσαρμοστούν στις νέες συνθήκες και να ενισχυθεί η δυνατότητα για νέες επιχειρηματικές ευκαιρίες. Οι νέοι κανόνες θα καθορίσουν τη σωστή ισορροπία, αφενός, προωθώντας τη δημιουργία και την καινοτομία, εν μέρει με τη διασφάλιση ανταμοιβής και επενδύσεων για τους δημιουργούς και, αφετέρου, προωθώντας την ευρύτερη δυνατή πρόσβαση σε αγαθά και υπηρεσίες που προστατεύονται από ΔΔΙ. Η επίτευξη αυτής της ισορροπίας θα αποτελέσει πράγματι τη διαφορά για τις επιχειρήσεις (είτε πρόκειται για τον καλλιτέχνη που εργάζεται μόνος είτε για τις μεγάλες φαρμακευτικές εταιρείες) ενθαρρύνοντας τις επενδύσεις στην καινοτομία. Αυτό θα ωφελήσει την ανάπτυξη και ανταγωνιστικότητα της ΕΕ που εξασφαλίζεται μέσω της ενιαίας αγοράς. Οι καταναλωτές θα επωφεληθούν από μια ευρύτερη και ευκολότερη πρόσβαση στις πληροφορίες και στο πολιτιστικό περιεχόμενο, για παράδειγμα, στην ηλεκτρονική μουσική. Η στρατηγική αφορά πολλά θέματα για τη διασφάλιση της πλήρους κάλυψης των ΔΔΙ - από το δίπλωμα ευρεσιτεχνίας που χρειάζεται μια επιχείρηση για να προστατεύσει μια εφεύρεση έως την αντιμετώπιση της κατάχρησης των εν λόγω εφευρέσεων μέσω πρότασης που εγκρίθηκε επίσης σήμερα, η οποία θα ενισχύσει τη δράση για την καταπολέμηση της παραποίησης/απομίμησης και της πειρατείας. Μεταξύ των πρώτων αποτελεσμάτων που παράγονται στο πλαίσιο αυτής της συνολικής στρατηγικής σε θέματα ΔΔΙ συγκαταλέγονται οι σημερινές προτάσεις οι οποίες αφορούν ένα πιο εύκολο σύστημα αδειοδότησης για τα αποκαλούμενα «ορφανά έργα» που θα επιτρέψει σε πολλά πολιτιστικά έργα να είναι προσβάσιμα ηλεκτρονικά, και νέο κανονισμό που αποσκοπεί στην ενίσχυση των δράσεων των τελωνειακών αρχών για την καταπολέμηση του εμπορίου προϊόντων που παραβιάζουν τα ΔΔΙ.

«Η διασφάλιση του κατάλληλου επιπέδου προστασίας των δικαιωμάτων διανοητικής ιδιοκτησίας στην ενιαία αγορά είναι ουσιαστικής σημασίας για την οικονομία της Ευρώπης. Η πρόοδος εξαρτάται από νέες ιδέες και γνώσεις», δήλωσε ο Επίτροπος Εσωτερικής Αγοράς κ. Michel Barnier. «Δεν θα υπάρξουν επενδύσεις στην καινοτομία, εάν τα δικαιώματα δεν προστατεύονται. Από την άλλη πλευρά, οι καταναλωτές και οι χρήστες πρέπει να έχουν πρόσβαση σε πολιτιστικό περιεχόμενο, όπως για παράδειγμα στη μουσική που διατίθεται ηλεκτρονικά, ώστε να ανθίσουν νέα επιχειρηματικά μοντέλα και η πολιτιστική πολυμορφία. Στόχος μας σήμερα είναι να επιτευχθεί ισορροπία μεταξύ αυτών των δύο επιταγών προς το συμφέρον των ΔΔΙ εν γένει, για να αποτελέσει το ευρωπαϊκό πλαίσιο σε θέματα διανοητικής ιδιοκτησίας καθοριστικό παράγοντα για τις επιχειρήσεις και τους πολίτες και να προσαρμοστεί στον ηλεκτρονικό κόσμο και στον παγκόσμιο ανταγωνισμό των ιδεών.»

Ο κ. Algirdas Šemeta, Επίτροπος αρμόδιος για τα Τελωνεíα, δήλωσε: «Η εγκατάσταση των τελωνείων στα σύνορα είναι ιδανική για να προστατεύει τους πολίτες και τις νομοταγείς επιχειρήσεις και η συμβολή τους είναι πολύτιμη στην καταπολέμηση της παραποίησης/απομίμησης και της πειρατείας». Και πρόσθεσε: «Είμαι πεπεισμένος ότι ένα εύρωστο σύστημα δικαιωμάτων διανοητικής ιδιοκτησίας είναι σημαντικό για το σύνολο της οικονομίας της ΕΕ. Με τη σημερινή πρόταση, οι τελωνειακές αρχές θα είναι σε θέση να παρέχουν μεγαλύτερη προστασία στα ΔΔΙ και να αντιμετωπίζουν καλύτερα το εμπόριο προϊόντων που παραβιάζουν τα ΔΔΙ.»

Στο πλαίσιο της στρατηγικής για τα ΔΔΙ καθορίζεται μια σειρά βραχυπρόθεσμων και μακροπρόθεσμων βασικών δράσεων πολιτικής σε διάφορους τομείς οι οποίοι περιλαμβάνουν:

Διπλώματα ευρεσιτεχνίας: Η Επιτροπή δρομολόγησε ήδη τον Απρίλιο προτάσεις για ένα ενιαίο καθεστώς προστασίας των ευρεσιτεχνιών στο πλαίσιο της ενισχυμένης συνεργασίας (βλ. IP/11/470). Εντωμεταξύ, θα συνεχισθούν οι εργασίες όσον αφορά τις προτάσεις σχετικά με τη δημιουργία ενός ενιαίου και ειδικού δικαστηρίου διπλωμάτων ευρεσιτεχνίας για το κλασικό ευρωπαϊκό δίπλωμα ευρεσιτεχνίας και τα μελλοντικά ευρωπαϊκά διπλωμάτα ευρεσιτεχνίας με ενιαία ισχύ. Αυτό θα μείωνε σημαντικά τα δικαστικά έξοδα και το χρόνο που απαιτείται για την επίλυση διαφορών για τα διπλώματα ευρεσιτεχνίας. Θα αύξανε επίσης την ασφάλεια δικαίου για τις επιχειρήσεις.

Εμπορικά σήματα: Ενώ η καταχώρηση του εμπορικού σήματος στην ΕΕ έχει εναρμονιστεί στα κράτη μέλη εδώ και περίπου 20 χρόνια και το κοινοτικό εμπορικό σήμα δημιουργήθηκε πριν από 15 χρόνια, υπάρχει μια αυξανόμενη ζήτηση για πιο σύγχρονα, αποτελεσματικά και συνεκτικά συστήματα καταχώρησης. Η Επιτροπή προτίθεται να υποβάλει προτάσεις εντός του 2011 για τον εκσυγχρονισμό του συστήματος εμπορικών σημάτων τόσο σε επίπεδο ΕΕ όσο και σε εθνικό επίπεδο και την προσαρμογή του στην εποχή του διαδικτύου.

Γεωγραφικές ενδείξεις (ΓΕ): Οι ΓΕ εξασφαλίζουν μια σχέση μεταξύ της ποιότητας του προϊόντος και της γεωγραφικής προέλευσής του. Ωστόσο, δεν υπάρχει επί του παρόντος ένα τέτοιο σύστημα σε επίπεδο ΕΕ για την προστασία των μη γεωργικών προϊόντων, όπως το μάρμαρο Carrara ή τα μαχαίρια Solingen. Αυτό οδηγεί σε απουσία ισότιμων όρων ανταγωνισμού στην ενιαία αγορά. Η Επιτροπή θα προβεί συνεπώς σε μια εις βάθος ανάλυση του ισχύοντος νομικού πλαισίου στα κράτη μέλη, καθώς και των πιθανών οικονομικών επιπτώσεων της προστασίας των μη γεωργικών ΓΕ το 2011 και το 2012. Ανάλογα με το αποτέλεσμα της αξιολόγησης των επιπτώσεων, θα μπορούσαν στη συνέχεια να υποβληθούν ενδεχομένως νομοθετικές προτάσεις.

Πολυεδαφική αδειοδότηση δικαιωμάτων πνευματικής ιδιοκτησίας: Ενώ το ουσιαστικό πεδίο εφαρμογής των δικαιωμάτων πνευματικής ιδιοκτησίας έχει εναρμονιστεί σε μεγάλο βαθμό, τα δικαιώματα εξακολουθούν να παρέχονται σε εθνική βάση. Στο πλαίσιο της ψηφιακής ενιαίας αγοράς, ο εξορθολογισμός της αδειοδότησης εκμετάλλευσης πνευματικών δικαιωμάτων και της κατανομής των εσόδων είναι μία από τις πιο σημαντικές προκλήσεις που πρέπει να αντιμετωπιστούν. Στο δεύτερο εξάμηνο του 2011, η Επιτροπή θα υποβάλει πρόταση για τη δημιουργία ενός νομικού πλαισίου για την αποτελεσματική πολυεδαφική συλλογική διαχείριση των δικαιωμάτων πνευματικής ιδιοκτησίας, ιδίως στον τομέα της μουσικής. Θα θεσπίσει επίσης κοινούς κανόνες για τη διαφανή διακυβέρνηση και την κατανομή των εσόδων. Κατά το δεύτερο εξάμηνο του 2011, η Επιτροπή θα ξεκινήσει επίσης διαβούλευση για τα διάφορα θέματα που σχετίζονται με την ηλεκτρονική διανομή των οπτικοακουστικών έργων.

Ψηφιακές βιβλιοθήκες: Η δημιουργία ευρωπαϊκών ψηφιακών βιβλιοθηκών που διατηρούν και διαδίδουν την πλούσια πολιτιστική και πνευματική κληρονομιά της Ευρώπης αποτελεί το κλειδί για την ανάπτυξη της οικονομίας της γνώσης. Για να διευκολυνθεί αυτή η διαδικασία, η Επιτροπή υποβάλλει επίσης σήμερα νομοθετική πρόταση η οποία θα επιτρέψει την ψηφιοποίηση και την ηλεκτρονική διάθεση των καλούμενων «ορφανών έργων» (όπως βιβλία και άρθρα εφημερίδων ή περιοδικών που εξακολουθούν να προστατεύονται από δικαιώματα πνευματικής ιδιοκτησίας, αλλά των οποίων οι κάτοχοι είναι άγνωστοι ή δεν μπορούν να εντοπιστούν για να παράσχουν την άδειά τους) - βλέπε MEMO/11/333. Παράλληλα, η Επιτροπή προσβλέπει στη σύναψη Μνημονίου Συμφωνίας μεταξύ των βιβλιοθηκών, των εκδοτών, των συγγραφέων και των εταιρειών συλλογικής διαχείρισης, το οποίο να διευκολύνει την επίλυση θεμάτων αδειοδότησης δικαιωμάτων για την ψηφιοποίηση και τη διάθεση των βιβλίων που έχουν εξαντληθεί.

Παραβίαση των ΔΔΙ: Η παραποίηση/απομίμηση και η πειρατεία αποτελούν αυξανόμενη απειλή για την οικονομία. Μεταξύ 2005 και 2009, ο αριθμός των καταγεγραμμένων περιπτώσεων, στα σύνορα της ΕΕ, εμπορευμάτων που είναι ύποπτα ότι παραβιάζουν δικαιώματα διανοητικής ιδιοκτησίας αυξήθηκε από 26.704 σε 43.572. Εντωμεταξύ, η δημιουργική βιομηχανία εκτιμά ότι η πειρατεία έχει κοστίσει στην ευρωπαϊκή μουσική, στον κινηματογράφο, την τηλεόραση και τη βιομηχανία λογισμικού 10 δισεκατομμύρια ευρώ και περισσότερες από 185.000 θέσεις εργασίας μόνο το 2008. Η Επιτροπή αναμένεται να εντείνει τις προσπάθειές της στον τομέα αυτό. Πρώτον, η Επιτροπή υπέβαλε σήμερα κανονισμό για την ενίσχυση του Ευρωπαϊκού Παρατηρητηρίου παραποίησης και πειρατείας, το οποίο ιδρύθηκε το 2009, με την ανάθεση των καθηκόντων του στο Γραφείο Εναρμόνισης στην Εσωτερική Αγορά (ΓΕΕΑ). Αυτό θα επιτρέψει στο Παρατηρητήριο να επωφεληθεί από την εμπειρογνωμοσύνη του ΓΕΕΑ σε θέματα διανοητικής ιδιοκτησίας και τη μεγάλη εμπειρία του όσον αφορά την χορήγηση εμπορικών σημάτων, σχεδίων και υποδειγμάτων. Ο κανονισμός διαβιβάζεται επί του παρόντος προς εξέταση στο Ευρωπαϊκό Κοινοβούλιο και το Συμβούλιο. Δεύτερον, την άνοιξη του 2012, η Επιτροπή θα προτείνει την αναθεώρηση της οδηγίας σχετικά με την επιβολή των δικαιωμάτων διανοητικής ιδιοκτησίας (βλ. IP/04/540). Η οδηγία προβλέπει μέτρα αστικού δικαίου που παρέχουν στους δικαιούχους τη δυνατότητα επιβολής των δικαιωμάτων διανοητικής ιδιοκτησίας τους, αλλά θα πρέπει να προσαρμοστούν, ιδίως προκειμένου να αντιμετωπιστούν οι συγκεκριμένες προκλήσεις του ψηφιακού περιβάλλοντος.

Επιβολή των ΔΔΙ από τις τελωνειακές αρχές: Τα τελωνεία εποπτεύουν όλες τις εμπορικές συναλλαγές που διέρχονται τα εξωτερικά σύνορα της ΕΕ: διενεργούν ελέγχους για πολλούς σκοπούς και έχουν ουσιαστικό ρόλο στην καταπολέμηση του εμπορίου εμπορευμάτων που παραβιάζουν τα ΔΔΙ. Μόνο το 2009, οι τελωνειακές αρχές κατάσχεσαν πάνω από 40.000 ύποπτα φορτία που περιείχαν 118 εκατομμύρια αντικείμενα. Παρότι η πλειονότητα των εμπορευμάτων που κατασχέθηκαν είναι εμπορεύματα παραποίησης/απομίμησης ή πειρατικά, η μοναδική θέση που κατέχουν τα τελωνεία στα σύνορα, τους επιτρέπει να επιβάλουν την τήρηση ενός ευρέος φάσματος δικαιωμάτων διανοητικής ιδιοκτησίας. Στο πλαίσιο της συνολικής στρατηγικής σε θέματα ΔΔΙ που υιοθετήθηκε σήμερα, η Επιτροπή προτείνει επίσης έναν νέο τελωνειακό κανονισμό που αποσκοπεί στην περαιτέρω ενίσχυση του νομικού πλαισίου των δράσεων των τελωνειακών αρχών. Η πρόταση αποσκοπεί επίσης στην αντιμετώπιση του εμπορίου μικρών αποστολών εμπορευμάτων παραποίησης/απομίμησης που αποστέλλονται ταχυδρομικώς, τα οποία, στη συντριπτική πλειοψηφία τους, απορρέουν από συναλλαγές που πραγματοποιούνται μέσω διαδικτύου.

Ιστορικό
Τα ΔΔΙ αποτελούν έναν από τους ακρογωνιαίους λίθους της οικονομίας της ΕΕ και καθοριστικό παράγοντα για την περαιτέρω ανάπτυξή της. Το 2009, η αξία των 10 πρώτων σημάτων σε χώρες της ΕΕ ανήλθε σχεδόν στο 9% του ΑΕΠ κατά μέσο όρο. Οι δημιουργικές βιομηχανίες που βασίζονται στα πνευματικά δικαιώματα, όπως ο κλάδος του λογισμικού, οι εκδόσεις βιβλίων και εφημερίδων, η φωνογραφική και η κινηματογραφική βιομηχανία, συνέβαλαν κατά 3,3% στο ΑΕΠ της ΕΕ το 2006 και αντιπροσωπεύουν περίπου 1,4 εκατομμύρια ΜΜΕ, δηλαδή 8,5 εκατομμύρια θέσεις εργασίας. Η απασχόληση σε κλάδους της «οικονομίας της γνώσης» αυξήθηκε κατά 24% μεταξύ 1996 και 2006 έναντι 6% σε άλλους κλάδους.

Πρόταση οδηγίας για τα ορφανά έργα

Στις 24 Μαΐου η Eυρωπαϊκή Επιτροπή δημοσίευσε μια στρατηγική για τον εκσυγχρονισμό των δικαιωμάτων διανοητικής ιδιοκτησίας στην Ενιαία Αγορά. Κάποιες από τις πρωτοβουλίες που περιλαμβάνονται στο πλαίσιο της στρατηγικής αυτής είναι η και Πρόταση Οδηγίας για τα Ορφανά Έργα, στην οποία θα αναφερθούμε εδώ.
Αξίζει προηγουμένως να σημειωθεί ότι στη Χώρα μας ο Οργανισμός Πνευματικής Ιδιοκτησίας διεξάγει διαβούλευση για την πρόταση οδηγίας και τα λοιπά προτεινόμενα μέτρα, στη διεύθυνση: http://web.opi.gr/portal/page/portal/opi

Τα ορφανά έργα, αλλά και όσα έργα έχουν εξαντληθεί, προκαλούν σημαντικά προβλήματα ιδίως όσον αφορά τη δημιουργία ψηφιακών βιβλιοθηκών. Ως ορφανά νοούνται τα έργα των οποίων οι δικαιούχοι δεν μπορούν να προσδιορισθούν ή δεν μπορούν να ευρεθούν, στην περίπτωση που είναι γνωστοί και δεν είναι έτσι δυνατόν να τους ζητηθεί η άδεια για την ψηφιοποίηση και δημοσιοποίηση των έργων τους στο Διαδίκτυο, ακόμα και με τη διενέργεια της πλέον επιμελούς έρευνας. Αυτό έχει ως συνέπεια να δημιουργείται ανασφάλεια στους χρήστες των έργων και ανυπέρβλητα εμπόδια στις ψηφιακές βιβλιοθήκες, καθώς απαιτείται μια μακρά διαδικασία για την ανεύρεση των δικαιούχων, ενώ το σχετικό κόστος είναι ιδιαίτερα υψηλό (Από τη σχετική βιβλιογραφία βλ. Για την επίλυση του ζητήματος υποβλήθηκε η πρόταση οδηγίας της 24.5.2011 COM(2011) 289 τελικό 2011/0136 (COD). Όπως προκύπτει από την αιτιολογική έκθεση της πρότασης οδηγίας, κύριος στόχος της είναι η δημιουργία ενός νομικού πλαισίου για την εξασφάλιση της νόμιμης, διασυνοριακής διαδικτυακής πρόσβασης σε ορφανά έργα που περιλαμβάνονται σε διαδικτυακές ψηφιακές βιβλιοθήκες ή αρχεία υπό τη διαχείριση διαφόρων οργανισμών που προσδιορίζονται στην παρούσα πρόταση, όταν τα εν λόγω ορφανά έργα χρησιμοποιούνται για την επίτευξη της αποστολής δημοσίου συμφέροντος των ανωτέρω οργανισμών. Στα έργα αυτά συγκαταλέγονται έργα που δημοσιεύονται με τη μορφή βιβλίων, επιστημονικών περιοδικών, εφημερίδων, περιοδικών ή άλλων γραπτών κειμένων, συμπεριλαμβανομένων και των έργων που είναι ενσωματωμένα σε αυτά, καθώς και οπτικοακουστικά και κινηματογραφικά έργα που περιλαμβάνονται στις συλλογές ιδρυμάτων κινηματογραφικής κληρονομιάς, και ακουστικά, οπτικοακουστικά και κινηματογραφικά έργα που παράχθηκαν από δημόσιους ραδιοτηλεοπτικούς οργανισμούς και περιλαμβάνονται στα αρχεία τους.


Ο εν λόγω στόχος δύναται να επιτευχθεί μέσω ενός συστήματος αμοιβαίας αναγνώρισης ενός έργου ως ορφανού. Προκειμένου να εξασφαλίσουν την αναγνώριση έργων ως «ορφανών»,
οι βιβλιοθήκες, τα εκπαιδευτικά ιδρύματα, τα μουσεία ή τα αρχεία, τα ιδρύματα κινηματογραφικής κληρονομιάς και οι δημόσιοι ραδιοτηλεοπτικοί οργανισμοί υποχρεούνται να πραγματοποιήσουν προηγουμένως επιμελή αναζήτηση, σύμφωνα με τις απαιτήσεις που ορίζονται στην προτεινόμενη οδηγία, στο κράτος μέλος όπου δημοσιεύθηκε αρχικά το έργο. Αν από την επιμελή αναζήτηση αποδειχθεί το καθεστώς ενός έργου ως «ορφανού», το σχετικό έργο θα θεωρείται ορφανό σε ολόκληρη την ΕΕ, καθιστώντας περιττή τη διενέργεια πολλαπλών επιμελών αναζητήσεων. Σε αυτή τη βάση, θα είναι δυνατή η διάθεση ορφανών έργων στο διαδίκτυο για πολιτιστικούς και εκπαιδευτικούς σκοπούς χωρίς προηγούμενη άδεια, εκτός εάν ο ιδιοκτήτης του έργου θέσει τέλος στο καθεστώς του ως ορφανού.

Ένας περαιτέρω στόχος της παρούσας πρότασης είναι να διασφαλίσει ότι το νομικό πλαίσιο που θα ισχύει για τα ορφανά έργα δεν θα παρακωλύει τη χρήση διευρυμένων συλλογικών αδειών που περιλαμβάνουν έργα που θα μπορούσαν να θεωρηθούν ως ορφανά. Ο ως άνω στόχος δύναται να επιτευχθεί με τον καθορισμό των προϋποθέσεων υπό τις οποίες τα κράτη μέλη μπορούν να επιτρέψουν την έκδοση συλλογικών αδειών που περιλαμβάνουν έργα κατόχων πνευματικών δικαιωμάτων οι οποίοι δεν έχουν συναινέσει ρητώς στην εκπροσώπησή τους από την εταιρεία συλλογικής διαχείρισης και τα οποία ενδέχεται να είναι ορφανά.

Σύμφωνα με το άρθρο 2 της πρότασης οδηγίας, ένα έργο θεωρείται ορφανό εάν ο κάτοχος των δικαιωμάτων του έργου δεν ταυτοποιηθεί ή, ακόμα και αν έχει ταυτοποιηθεί, δεν εντοπιστεί μετά από τη διενέργεια επιμελούς αναζήτησης του κατόχου των δικαιωμάτων σύμφωνα με το άρθρο 3. Παραπέρα, ορίζεται ότι σε περίπτωση που ένα έργο έχει περισσότερους από έναν κατόχους δικαιωμάτων, και ένας από αυτούς έχει ταυτοποιηθεί και εντοπιστεί, το έργο δεν θεωρείται ορφανό.

Στο άρθρο 3 εισάγεται ο κανόνας της επιμελούς αναζήτησης, σύμφωνα με τον οποίο, προκειμένου να εξακριβωθεί αν ένα έργο είναι ορφανό, οι οργανισμοί (δημόσιες βιβλιοθήκες, εκπαιδευτικά ιδρύματα ή μουσεία, αρχεία, ιδρύματα κινηματογραφικής κληρονομιάς και δημόσιους ραδιοτηλεοπτικούς οργανισμούς), τους οποίους αφορά η οδηγία, διασφαλίζουν τη διενέργεια επιμελούς αναζήτησης για κάθε έργο, καταφεύγοντας στις κατάλληλες πηγές για την κατηγορία των σχετικών έργων. Πιο πέρα, προβλέπεται ότι οι πηγές που είναι κατάλληλες για κάθε κατηγορία έργων καθορίζονται από κάθε κράτος μέλος, κατόπιν διαβούλευσης με τους κατόχους δικαιωμάτων και τους χρήστες, και περιλαμβάνουν τις πηγές που αναφέρονται στο παράρτημα, καθώς και ότι η διενέργεια επιμελούς αναζήτησης απαιτείται να διεξάγεται μόνο στο κράτος μέλος της πρώτης δημοσίευσης ή αναμετάδοσης, ενώ τα κράτη μέλη πρέπει να διασφαλίζουν ότι τα αποτελέσματα των επιμελών αναζητήσεων που διεξάγονται εντός των συνόρων τους καταγράφονται σε βάση δεδομένων ανοιχτή για το κοινό.

Άλλος κανόνας που παρουσιάζει ενδιαφέρον είναι ο κανόνας της αμοιβαίας αναγνώρισης, σύμφωνα με τον οποίο, ένα έργο που θεωρείται ορφανό δυνάμει του άρθρου 2 σε ένα κράτος μέλος θεωρείται ορφανό έργο σε όλα τα κράτη μέλη.

Παραπέρα, για τη λήξη του καθεστώτος των ορφανών έργων ορίζεται ότι ο κάτοχος των δικαιωμάτων ενός έργου που θεωρείται ορφανό έχει, ανά πάσα στιγμή, τη δυνατότητα να θέσει τέλος στο καθεστώς του έργου ως ορφανού.

Η πρόταση οδηγία ρυθμίζει στη συνέχεια τις επιτρεπόμενες και τις εγκεκριμένες χρήσεις ορφανών έργων. Ειδικότερα, οι σχετικές διατάξεις των άρθρων 6 και 7έχουν ως εξής:

Άρθρο 6- Επιτρεπόμενες χρήσεις ορφανών έργων
1. Τα κράτη μέλη διασφαλίζουν ότι οι οργανισμοί που αναφέρονται στο άρθρο 1 παράγραφος 1 επιτρέπεται να χρησιμοποιούν ένα ορφανό έργο με τους κατωτέρω τρόπους:
α) θέτοντας το ορφανό έργο στη διάθεση του κοινού, κατά την έννοια του άρθρου 3 της οδηγίας 2001/29/ΕΚ 11
β) μέσω αναπαραγωγής, κατά την έννοια του άρθρου 2 της οδηγίας 2001/29/ΕΚ, για σκοπούς ψηφιοποίησης, διάθεσης στο κοινό, ευρετηρίασης, καταλογογράφησης, συντήρησης ή αποκατάστασης.
2. Ωστόσο, εκτός εάν προβλέπεται άλλως στο άρθρο 7, οι οργανισμοί που αναφέρονται στο άρθρο 1 παράγραφος 1 δεν επιτρέπεται να χρησιμοποιούν ορφανά έργα για να επιτύχουν στόχους που δεν εμπίπτουν στις αποστολές τους δημοσίου συμφέροντος, και συγκεκριμένα στη συντήρηση, την αποκατάσταση και την παροχή πολιτιστικής και εκπαιδευτικής πρόσβασης στα έργα που περιλαμβάνονται στις συλλογές τους. 3. Η παρούσα οδηγία εφαρμόζεται υπό την επιφύλαξη της ελευθερίας των εν λόγω οργανισμών να συνάπτουν συμβάσεις κατά την εκτέλεση των αποστολών τους δημοσίου συμφέροντος.
4. Τα κράτη μέλη διασφαλίζουν ότι οι οργανισμοί που αναφέρονται στο άρθρο 1 παράγραφος 1, όταν χρησιμοποιούν ορφανά έργα σύμφωνα με την παράγραφο 1, τηρούν αρχεία της επιμελούς αναζήτησης που διεξήγαγαν και αρχεία χρήσης ανοιχτά στο κοινό.

Άρθρο 7 - Εγκεκριμένες χρήσεις ορφανών έργων
1. Τα κράτη μέλη δύνανται να παρέχουν άδεια στους οργανισμούς που αναφέρονται στο άρθρο 1 παράγραφος 1 να χρησιμοποιούν ένα ορφανό έργο για άλλους σκοπούς εκτός από εκείνους που αναφέρονται στο άρθρο 6 παράγραφος 2, υπό την προϋπόθεση ότι:
(1) οι οργανισμοί που αναφέρονται στο άρθρο 1 παράγραφος 1 τηρούν αρχεία της επιμελούς αναζήτησης που διεξήγαγαν·
(2) οι οργανισμοί τηρούν αρχεία ανοιχτά στο κοινό σχετικά με τη χρήση των ορφανών έργων από τον οργανισμό·
(3) στην περίπτωση ορφανού έργου όπου ο κάτοχος δικαιωμάτων έχει ταυτοποιηθεί, αλλά δεν έχει εντοπιστεί, το όνομα του κατόχου δικαιωμάτων αναφέρεται σε κάθε χρήση του έργου·
(4) οι κάτοχοι δικαιωμάτων που θέτουν τέλος στο καθεστώς του έργου ως ορφανού, κατά την έννοια του άρθρου 5, αμείβονται για τη χρήση του έργου που έχει γίνει από τους οργανισμούς που αναφέρονται στο άρθρο 1 παράγραφος 1.
(5) οι κάτοχοι δικαιωμάτων δύνανται να αξιώσουν την αμοιβή τους βάσει του σημείου 4 εντός προθεσμίας που ορίζεται από τα κράτη μέλη και η οποία δεν μπορεί να είναι μικρότερη των πέντε ετών από την ημερομηνία της πράξης που γέννησε την αξίωση.
2. Τα κράτη μέλη μπορούν να επιλέξουν τα μέσα για την παροχή άδειας χρήσης κατά την έννοια της παραγράφου 1, και παραμένουν ελεύθερα να αποφασίσουν για τη χρήση οιωνδήποτε εσόδων δεν έχουν απαιτηθεί μετά τη λήξη της προθεσμίας που ορίζεται σύμφωνα με την παρ. 1 σημείο 5.

ICAIL 2011: The Thirteenth International Conference on Artificial Intelligence and Law June 6, 2011 – June 10, 2011


The 13th International Conference on AI and Law (ICAIL 2011) will be held in Pittsburgh, Pennsylvania, USA, June 6-10, 2011, at the University of Pittsburgh School of Law under the auspices of the International Association for Artificial Intelligence and Law (IAAIL), an organization devoted to promoting research and development in the field of AI and Law with members throughout the world.

The field of AI and Law is concerned with:

- the study of legal reasoning and argumentation, using computational methods
- the formal representation of norms, normative actions, normative systems and norm-governed societies and multi-agent systems
- the investigation of techniques from advanced information technology, using law as the illustrative domain
- applications of advanced information technology to support tasks in the legal domain.

ICAIL provides a forum for the presentation and discussion of the latest research results and practical applications and stimulates interdisciplinary and international collaboration. Previous ICAIL conferences have been held biennially since 1987, with proceedings published by ACM.

Data, Knowledge, and Discovery in Legal Cases

David D. Lewis Consulting

Abstract: The past decade has seen the birth of a multi-billion dollar electronic discovery (e-discovery) software and services industry in which information retrieval (IR) and artificial intelligence (AI) methods play a pivotal role. Machine learning and statistical IR play a central role, and I will review their applications in e-discovery, as well as the perceptions that have emerged about them in the e-discovery community. I then take up two very different ways in which the demands of e-discovery suggest new research areas for AI. First, I make the case that knowledge-based methods should, and are likely to, play a larger role in e-discovery in the future. Second, I outline a new computational learning theory framework (Finite Population Annotation) motivated by the nature of machine learning applications in e-discovery, and the need for their outputs to stand up in court.

Biography: David D. Lewis, Ph.D. (www.DavidDLewis.com) is a Chicago-based consulting computer scientist working in the areas of information retrieval, data mining, natural language processing, and the evaluation of complex information systems. He formerly held research positions at AT&T Labs, Bell Labs, and the University of Chicago. He has published more than 75 scientific papers and 8 patents, and was elected a Fellow of the American Association for the Advancement of Science in 2006.

Rules-Driven Business Services: Flexibility within the Boundaries of the Law

Abstract: The Dutch Immigration and Naturalization Service (IND) is renewing its organization, business processes and complete IT landscape in the Renewal Program “IND with the Times”. One aspect of this program is the new information system INDiGO. This is a knowledge-based, service-oriented system, composed of standard components (Siebel, FileNet, Oracle Fusion Middleware) and a rule engine (BeInformed). The rule engine contains all knowledge on relevant laws, regulations and policies and offers this knowledge ‘as-a-service’. But the rule engine also contains knowledge on the process flow, i.e. the order in which the 165 Business Services are to be executed. At any moment in time, the rule-engine can be consulted to provide those Business Services that are relevant to the specific case and customer at that specific moment. This creates a highly flexible system; changes in law, regulation or procedures can be changed and implemented very quickly through the use of this rule engine. Moreover, the system is event driven; events that have an impact on the flow (the decision making process) can be evaluated as they occur. Last but not least, INDiGO is designed to support the highly skilled, professional end-user, who remains in control at all times. In this presentation the focus will be on the guiding principles behind the information system (the separation of the “know” from the “flow”), the approach and methodology employed, the implementation strategy and, of course, the lessons learned.

Biography: Jorke van der Pol is a senior advisor at the Dutch Immigration and Naturalization Services. Currently he is involved in solving various business challenges with an IT component. Making full use of his expertise and on-the-ground experience of immigration and naturalisation law and procedures, he searches for (technological) solutions in the fields of rule governance. His approach can be characterized as agile and result-oriented. He is involved in various projects within the INDiGO project.

Models of the Law in AI & Law

Abstract: I will address the different ways in which the law has been and may be seen by the AI & law community. First I will consider what aspects of the law are most relevant to the main lines of inquiry of AI & law, such as information retrieval, rule-based reasoning, case-based reasoning, ontologies, argumentation, theory construction and multi-agent systems. I will argue that a rich picture of the law is emerging from the AI & law research, which in some respects goes beyond the accounts currently provided by legal theory. Then, I will address norm-based societies of autonomous agents, where agents themselves have to identify what norms apply to them, in what context, and may be able to produce the norms governing their interaction. I will argue that to model normative reasoning in such contexts we need to address the dynamical nature of normative systems, namely, the way in which social facts change the content of normative systems, and how agents can refer to such facts for determining what norms they are subject to. Finally, I shall consider how agents, when faced with the request of multiple normative systems, can reason using multiple normative references and taking into account intra-systemic connections.

Biography: Giovanni Sartor is professor of Legal informatics and Legal Theory at the Faculty of Law of the University of Bologna - Cirsfid, and at European University Institute of Florence. He obtained a PhD at the European University Institute (Florence), worked at the Court of Justice of the European Union (Luxembourg), was a researcher at the Italian National Council of Research (ITTIG, Florence), held the chair in Jurisprudence at Queen’s University of Belfast. He is current President of the International Association for Artificial Intelligence and Law. He has published widely on legal reasoning, argumentation, computational logic, legislation technique, and computer law.

Beyond Jeopardy!: Prospects for DeepQA in Legal Text Analysis

Abstract: The success of IBM's Watson system in the Jeopardy! challenge has raised the public's awareness of question answering technology, and the prospects for its application in real-world domains such as health care and law. This presentation combines an overview of the DeepQA software architecture that powers Watson with a discussion of possible areas of application for the legal profession.

Biography: Dr. Eric Nyberg is a Professor in the Language Technologies Institute in the School of Computer Science at Carnegie Mellon University. Since joining the CMU faculty in 1993, his research has focused on practical applications of language technologies in areas such as machine translation and question answering. Most recently, Dr. Nyberg collaborated with IBM's David Ferrucci and others to found the Open Advancement of Question Answering initiative, a framework for industry-university collaboration, which seeks to advance the use of question answering technology in multiple application domains.

Law, Technology and the New Paradigm of Performance

Symposium at the occasion of the retirement of Professor Richard V. De Mulder

During his long academic career, Richard De Mulder has introduced and evaluated a whole number of new paradigms and theories. This already started when he was teaching criminal law, as a member of the Louk Hulsman group, right at the beginning of his work at Erasmus University. It really took a flight, however, after he turned his attention to the subject of ‘Computers and Law’. He was a founding father of the research as well as the education in this field in The Netherlands.
Not satisfied with just that, he took an interest in management science, which not only led to the completion of an MBA, but also to the incorporation of this subject in his research and teaching of the application of information technology in the field of law. One of the results of that was an added interest in ‘legal knowledge management’, which is still a core subject for the ‘Centre for Comptuters and Law’ at Erasmus University.
All this and even more will be dealt with during a symposium that will be organized at the occasion of his retirement, on July 1, 2011.

Ten years later, his ideas were generally accepted in the world of business and in academia.
Nowadays, Professon Michael Jensen has again put his reputation on the line by introducing a new Paradigm. On the first of July, 2011, from 13.30 to 15.30, he will stress the importance of integrity, one of the main elements of the new Paradigm of Performance. You can judge for yourself whether he has got it right again. (By the way, if you get the new Paradigm, you won’t even want to judge.)

Νόμος για την ηλεκτρονική διακυβέρνηση


Ψηφίσθηκε στη Συνεδρίαση της Βουλής της 24ης Μαίου το Νομοσχέδιο για την Ηλεκτρονική Διακυβέρνηση και με τη δημοσίευσή του στο ΦΕΚ θα γίνει νόμος του κράτους. Με το νομοθετικό αυτό κείμενο εισάγεται η δημόσια διοίκηση της Χώρας μας στην ψηφιακή εποχή. Για πρώτη φορά προβλέπεται η δυνατότητα έκδοσης ηλεκτρονικών εγγράφων και γίνεται πράξη η ηλεκτρονική διακυβέρνηση, με ταυτόχρονο σεβασμό της προστασίας των προσωπικών δεδομένων των πολιτών.

Στην πράξη βέβαια για να εφαρμοστεί ο νόμος απαιτείται η δημιουργία επιτροπών ηλ. διακυβέρνησης σε κάθε υπουργείο και η σύσταση διακυβερνητικής επιτροπής, με παράλληλη έκδοση προεδρικών διαταγμάτων. Σύμφωνα με την Αιτιολογική Έκθεση επί του νομοσχεδίου, με το προτεινόµενο σχέδιο νόµου επιδιώκεται η δηµιουργία των κανονιστικών προϋποθέσεων και της θεσµικής υποδοχής για την προώθηση της ηλεκτρονικής διακυβέρνησης σε όλο το εύρος του δηµόσιου τοµέα, συµπεριλαµβανοµένων των ΟΤΑ αλλά και των ΝΠΙΔ που ελέγχονται από το Κράτος.
Με αυτό το σχέδιο νόµου που συνιστά το πλαίσιο καθιέρωσης και ανάπτυξης της ηλεκτρονικής διακυβέρνη-
σης επιδιώκεται:

α. η δηµιουργία των θεσµικών προϋποθέσεων για την επικοινωνία και συναλλαγή των πολιτών και των επιχει-
ρήσεων µε τους φορείς του δηµόσιου τοµέα µε χρήση των τεχνολογιών πληροφορικής και επικοινωνιών
β. η αναδιοργάνωση των εσωτερικών λειτουργιών και διαδικασιών των φορέων του δηµόσιου τοµέα επί τη βά-
σει της πλήρους αξιοποίησης των τεχνολογιών πληροφορικής και επικοινωνιών
γ. Η ευχερέστερη άσκηση των δικαιωµάτων και εκπλήρωση των υποχρεώσεων των φυσικών προσώπων αλλά
και των ΝΠΙΔ έναντι των Φορέων του Δηµόσιου Τοµέα.
δ. Η άρση κανονιστικών εµποδίων για την ταχεία και αποτελεσµατική πρόσβαση σε δηµόσιες υπηρεσίες και
πληροφορίες.

LEX 2011 Summer School: Managing Legal Resources in the Semantic Web

Στις 5-10 Σεπτεμβρίου 2011 διοργανώνονται θερινά μαθήματα με θέμα τη διαχείριση των νομικών πηγών πληροφόρησης στο Πανεπιστήμιο της Μπολόνια, στη Ραβένα της Ιταλίας LEX (2011 Summer School: Managing Legal Resources in the Semantic Web).

Τα μαθήματα διαρκούν 6 ημέρες και οργανώνεται σε δύο φάσεις. Το βασικό μάθημα είναι μια εισαγωγή στις τεχνολογίες XML και στις βασικές τεχνολογίες για το σχεδιασμό και τη διαχείριση νομοθετικών και νομικών κειμένων με βάση ορισμένα πρότυπα.

Κοινοποίηση δικαστικής απόφασης μέσω του κοινωνικού δικτύου Τwitter


Πρωτοποριακή είναι η μέθοδος επίδοσης δικαστικής απόφασης για παράλειψη χρήσης του ονόματος του ενάγοντος, στην οποία κατέφυγε το Ανώτατο Δικαστήριο της Βρετανίας. Συγκεκριμένα, η απόφαση κοινοποιήθηκε μέσω του Twitter ! Συγκεκριμένα, με την εν λόγω απόφαση διατάσσεται πρόσωπο που χρησιμοποιούσε ανώνυμα το παραπάνω κοινωνικό δίκτυο, να αναστείλει την αποστολή μηνυμάτων μέσω της ταυτότητας άλλου προσώπου.

UK High Court Serves Injunction Over Twitter

For the first time, a U.K. court delivered an injunction over Twitter on Thursday, a groundbreaking embrace of technology by a traditionally slow-moving legal system.

The injunction orders an anonymous person to stop impersonating Donal Blaney, a prominent right-wing blogger and owner of the Griffin Law firm based in Hawkhurst, England.

The impersonator had set up a Twitter account that used Blaney's photo from his blog, linked to his blog posts and tweeted with the same style and tone of writing. While parody could be a defense, in this case "it was clearly designed to encourage people to think it was truly me," Blaney said.

Blaney's attorney went to the U.K.'s High Court in London on Thursday morning. The injunction was delivered by Twitter's direct message feature to the impersonator, so it is not public. The tweet contained a link to the injunction, which orders the person to reveal their identity and stop impersonating Blaney on Twitter.

The judge, who was familiar with Twitter, also knew of a case in Australia where court proceedings were delivered over Facebook, Blaney said.

The delivery of an injunction over Twitter is innovative and "will make it harder for people who are abusing the Internet and abusing the cowardly cloak of anonymity to harass and bully people," Blaney said.

If the impersonator doesn't get in touch with the court, Blaney has a couple of options, although identification of the person could be difficult. He could get a penal notice from the court, which would warn that the impersonator could be held in contempt of court for not coming forward.

However, penal notices must be served in person, Blaney said, and it's unlikely a judge would allow one to be delivered over Twitter.

Another option would be to file separate proceedings against Twitter in California to reveal the IP (Internet Protocol) address of the computer that posted the tweets. Then, it would be possible to ask the ISP (Internet service provider) to reveal the subscriber's identity or location of the computer. That is a "slow and expensive process," Blaney said.

The impersonator's account was still active as of Friday morning, he said.

Blaney went directly to the court instead of immediately contacting Twitter because the service can take a week to remove a fraudulent account, said he, based on his experience with one of his clients. He sent an e-mail to Twitter this morning asking for the account to be removed.

Part of his frustration stems from the fact that Twitter has no public phone line to report complaints, and users who feel there is inappropriate contact must just send an e-mail, Blaney said.

"It is unacceptable that a site as powerful as Twitter is behaving in the same manner as an ISP a decade ago," Blaney said.

Because of increasing abuse by spammers, phishers and other scams, ISPs have generally improved their response times now when alerted to problems on their networks. Social networking sites such as MySpace and Facebook, which grew very rapidly, have also made efforts to improve their reaction times.

Regulation models addressing data protection issues in the EU concerning RFID technology

Abstract

Radio frequency identification (RFID) is a new technology that will boost productivity and lead to a change of paradigm, as we move into ubiquitous computing and the introduction of the so-called “Internet of things”. This technology also has significant privacy implications, since processing of personal data with RFID technology takes place unnoticed and it enables identification and profiling of a person; thus, it may lead to covert monitoring of individuals, which will infringe their privacy. Issues of data protection and security with regard to RFID are addressed by various recommendations and guidelines. The provisions of Directive 2002/58 as amended by Directive 2009/136 also apply in certain cases; however, there are still issues to be tackled, and new regulatory approaches are required.

1 Introduction

Radio frequency identification (RFID) is a new technology that is destined to change our lives in many areas, such as logistics, healthcare, public transport, the retail trade, etc., as it provides new business opportunities, cost reduction and increased efficiency (Commission, 2009). RFID uses radio waves for the automatic identification of individual items and thus, it allows the processing of data over short distances (Bannon, 2008). In more particular, RFID systems are considered as the next generation of bar codes, offering much more advantages, since they identify uniquely objects which bear a RFID tag, without line-of-sight contact, and allow for wireless transmission of data and connecting to databases and applications (A. Juels, 2006).

The main components of an RFID infrastructure are a tag and a reader. The tag on the one hand consists of an electronic circuit that stores data and an antenna which transmits the data, while the reader on the other hand has an antenna which receives the data and a demodulator which translates the analogue information into digital data (Article 29 Working Party, 2005, p. 3). The RFID reader sends and receives back signals from the tags via one or more antennas and transmits the data to databases or software applications.

An RFID tag can be easily embedded onto various products, their packages or even be implanted beneath the skin of a human (Talidou, 2006). The size of the RFID tag, which is particularly small, about 0,4 mm2, is an important factor for its proliferation.

A common taxonomy of RFID systems makes a distinction between passive tags, i.e. those tags that have no own power supply and receive energy from the reader antenna, and active tags, i.e. those tags that have their own power supply. Passive RFIDs are very small and inexpensive and their life span is almost unlimited and this makes them ideal for tracking materials through supply chains (R. Levary et al., 2005). Active tags are more powerful, as they can emit the stored data, rewrite those data and store new data. However, their life cycle is shorter. Since they present more possibilities of data processing they are considered more privacy intrusive (Synodinou, 2009).

The applications of RFID technology are extended in many sectors. The retail sector was one of the first to adopt this technology, which provides the retailer the possibility to control and lever the availability of products in a store and in storage. It also makes possible product traceability and recall of faulty or unsafe products, etc. It makes, therefore, no surprise that an unprecedented growth in sales of passive EPC RFID tags took place in 2010 and that the sales volume exceeded one billion units , while prices of tags also are decreasing.

In transportation and logistics, the said systems are implemented in order to track vehicles and products, providing security during transport. Particularly, high is the importance of this technology with regard to public transportation and as far as electronic toll collection and access to public transportation (e.g., e-ticket) are concerned (Talidou, op.cit.).

Furthermore, of great importance is RFID technology in healthcare, where it is implemented to make tracking of medicines easier and prevent counterfeiting and loss derived from theft during transportation. It would also enable pharmacists or stores selling medicines to verify the origin of medicine. In hospitals such systems may be used, e.g., to eliminate the risk of leaving items inside a patient after an operation and to locate track personnel in case of emergency, while RFID tags may be attached to patients so that it would be easier for the personnel to treat them (WP, op. cit., p. 4).

Other applications of RFID are implemented for security and access control, e.g., to monitor valuable equipment or as components in a car immobilizer system, in aviation for baggage handling purposes, in libraries as a replacement of electro-magnetic and bar code systems of control, for the tracking animals, but also for the tracking of people. It is notable that a club in Barcelona offered its clients a RFID microchip that had to be implanted in their arms, which would gave them access to VIP lounges and could also be used for billing. Last, but not least, RFID chips are used in passports and identity cards, as they provide enhanced security as regards identification of individuals.


2 The risks to privacy

An invasion to informational privacy might occur in case personal data are being processed by automatic or traditional methods. The sole requirement for the respective data protection rules to apply is that information undergoing processing is qualified as personal data, i.e. as information relating to an identified or identifiable natural person, in the sense of the Data Protection Directive. For RFID systems to underlie the provisions of a data protection act it is, thus, required that RFID information are directly or indirectly referred to a natural person (WP, op. cit., p. 8).

This is the case, at first hand, where RFID systems are implemented in order to collect information directly or indirectly linked to personal data, so e.g., where products from a store are tagged with unique product codes which the retailer combines with customer names collected upon payment with credit cards and link them with the customer database. It is also the case where personal data is stored in RFID tags, so, e.g. in transport ticketing. And finally, RFID systems may be used to track individuals without a direct link to a natural person. It may happen, e.g., that a store provides cards with RFID tags to its customers and then monitor their shopping habits and make use of relevant data for marketing purposes. Even if the customer is not directly identified by means of the tagged card, he can be identified each time he visits the same shop as the holder of the card. Similarly, an individual can be tracked by shops which scan tagged products of customers. And further, third parties may use readers to detect tagged items of by passers, violating in that way their privacy (WP, op. cit., p. 6-7).

As it is obvious from the aforementioned examples, RFID technology provides the potential for tracking and profiling of individuals. Due to the fact that RFID tags can be read without line-of-sight and from a distance without being noticed, they are prone for application by retailers for customer profiling, as well as for monitoring for other purposes, e.g., for law enforcement purposes, etc. Such practices are infringing, however, the right to privacy of individuals, as they are not complying with basic principles of data protection legislation.

Besides that there are also security threats arising from the fact that RFID tags can be secretly read, particularly in case they are hidden inside product packaging or other items and devices, and since RFID readers can also be concealed (Ayoade, 2007, p. 558). Security issues arise for businesses, referring to espionage, unauthorized access of competitors to customers’ preferences and security attacks (DoS, etc.). Personal privacy threats are more important, since individuals are exposed to the risk of their behavior being covertly monitored (Garfinkel et al., 2005).


3 Compliance with legal requirements of data protection

3.1 Directive 1995/46

The Article 29 Data Protection Working Party in working document of January 19, 2005 stresses out those data controllers which implement RFID systems must comply with the obligations of the data protection Directive (WP, op. cit., p. 5 et seq.). Accordingly, the principles related to data quality must be observed, i.e., the use limitation, data quality and conservation principles. Thus, any further processing of data, which is incompatible with the purposes of collection, is prohibited, further that irrelevant personal data must not be collected and data must be kept for no longer than it is necessary for the purpose of collection or processing.

What is more important is that data processing must be based on one of the grounds of legitimization foreseen in Article 7 of the Directive. Thus, data processing will be based in most cases on consent of the data subject, as the other requirements are not fulfilled, with the exception of the case where processing is necessary in order to protect the vital interests of the data subject, e.g. where RFID technology is used in the health sector to track items used in surgical operations or to identify and provide treatment to patients. Wherever RFID systems are implemented, e.g., by stores that offer loyalty cards to their customers should require consent from their customers to collect and process their personal data, since this would go beyond the scope of the contract.

Where RFID systems are used by corporations and stores to track products to prevent theft etc., it is appropriate to examine whether processing is necessary for the purposes of legitimate interests pursued by the controller. In our view, this requirement is not fulfilled, if tags do not incorporate privacy features, such as the “kill” command, i.e. the possibility to permanently or temporarily deactivate the tag, or the blocking of a tag (Ayoade, op. cit., p. 559). Other technical solutions that have been proposed are i) the use of encryption on tags and ii) the inclusion of a privacy bit, i.e. a logical bit resident in the memory of an RFID tag indicating the privacy properties of the tag (Talidou, op. cit., p. 14).

The Working Party also emphasizes that data controllers that use RFID systems must fulfill the information requirements, guarantee the data subject’s right of access and implement appropriate technical and organizational measures. Particularly, as regards the right of information, it is underlined that a retailer shop which employs RFID technology must provide data subjects at least with clear notice about following information: a) the presence of RFID tags on products or their package and the presence of readers, b) whether the presence of such devices enables the tags to broadcast information without individual engaging in any active action, c) the purposes for which the information is used and iv) the identity of the controller. Furthermore, data controllers must inform individuals how to discard, disable or remove tags from products and how to exercise the right of access.

However, here lies a difficulty: how can the owner of a tagged item determine what information is on the tag, who processes the stored data and for which purposes? (Flint, 2006). Due to the technical characteristics of RFID tags the right of information seems hardly realizable and only with increased cost of the tag (Garfinkel et al., 2005).


3.2 Directive 2002/58

The provisions of Directive 2002/58 on privacy in electronic communications apply also to RFID systems, particularly as this was amended by Directive 2009/136 , which re-defined the field of application of the former Directive. It applies thus “to the processing of personal data in connection with the provision of publicly available electronic communications services in public communications networks in the Community, including public communications networks supporting data collection and identification devices”.

Consequently, data controllers must comply with those provisions of the Directive which are relevant in case of data processing in RFID systems. In accordance with Article 5 (3), the storing of information or the gaining of access to information stored in the terminal equipment of a user, i.e. in an RFID tag, is only allowed if the user has given his consent, or if it is necessary for the provision of an information society service. The latter condition is not fulfilled in the context of RFID systems and therefore, consent to write data or gain access to data in RFID tags is compulsory.

The consent of the user is also necessary condition for the use of RFID technology for the purposes of direct marketing, pursuant to Article 13 of the Directive.

Furthermore, data stored in RFID tags can be regarded as location data, in the sense of Article 2 lit. c of the Directive, i.e. as data indicating the geographic position of the terminal equipment of a user. This is particular significant, since users can be located and their associations can be tracked (Talidou). Article 9 of the Directive provides for that users’ or subscribers’ consent must be given for the processing, as well as that they must be informed about the details of the processing before they provide their consent.

However, the field of application of this Directive is restricted only to processing taking place in public communications networks and thus, RFID applications which do not use such a network are exempted.


3.3 A Privacy and Data Protection Impact Assessment Framework

The European Commission issued a recommendation of May 12, 2009, in which it elaborated on self-regulation mechanisms and in particular, on the development of a framework for privacy and data protection impact assessment (Recommendation, 2009). In this recommendation it invites EU Member States to ensure that the industry in collaboration with relevant civil society develops a framework for privacy and data protection impact assessment (PIA), which would be submitted for endorsement to the Art. 29 Working Party.

It also calls Member States to identify applications posing information security threats and develop a concise, accurate and comprehensible information policy for RFID applications. It provides that operators must inform individuals of the presence of tags, using a common European sign developed by European Standardisation Organizations. And it goes even further, as it provides that retailers should deactivate or remove at the point of sale tags used in their application unless consumers give their consent to keep tags operational (Commission, op. cit., Nr. 11). This obligation may not apply, in case an impact assessment concludes that tags which used in a retail application and remain operational after the point of sale do not represent a likely threat to privacy.

Subsequently, an informal workgroup led by industry representatives delivered on March 31st 2010, a PIA of RFID applications, in cooperation with stakeholders including consumer groups, standardization bodies, and university scholars. The Working Party was critical and did not endorse the proposed the proposed Framework. It laid down its objection in Opinion 5/2010, in which it invited the industry to propose a revised privacy and data protection impact assessment framework. ENISA also published an opinion, making recommendations to improve the proposed PIA. Next, the industry redrafted a revised PIA framework and this which was submitted for endorsement to the Article 29 Working Party on January 12, 2011. The Working Party delivered an affirmative opinion, endorsing the Revised Framework. In its opinion, the Working Party acknowledges that a PIA is a tool designed to promote “privacy by design”, better information to individuals as well as transparency and dialogue with competent authorities.



4 Regulation vs Self-Regulation

It is indisputable that privacy issues related to RFID technology can not be solved by means of existing legislation alone and that tools other than regulation are necessary. Evidently, the provisions of the EU Data Protection Directive are too general, while the ones of the eCommunication Directive are restrictive as to their scope. In our view, there are two ways to solve this issue: one is to provide for mandatory PIA that would be made available to data protection authorities and the other alternative is to provide for mandatory technical solutions (privacy enhancing technologies) in RFID technology.

In more particular, although the existing Data Protection Directive contains rules that could be applied to data processing in RFID systems, its provisions are very general and in many cases it is unclear whether the processing includes personal data. The eCommunications Directive also contains interesting provisions, but it can only apply in processing taking place in public communications networks.

The PIA Framework that was endorsed by the Article 29 Working Party is an important instrument and its basic advantage is that it applies differently in each specific application, depending on the risk posed. It also provides for the documentation of System Protection and RFID Tag Protection, including access controls, policies on the retention and disposal of personal data, and technical measures such as encryption to ensure the confidentiality of the information, tamper resistance of the tag and deactivation or removal of the tag, if required or otherwise provided. However, the recommendation on which the PIA Framework was based is not mandatory, but it is drafted to provide guidance to EU Member States on the design and operation of RFID applications. Thus, the effects of the proposed measures remain unsure, as it is not certain whether Member States will implement this recommendation and in which way, if they will make it mandatory or introduce it as part of a code of conduct, etc.

To effectively address the data protection issues posed by RFID technology another regulatory approach is needed. In particular, this will require making the PIA process mandatory, providing also for the notification of its results to the competent data protection authorities, which should have the right to prior checking of RFID systems posing significant privacy risks.

Alternatively, the data protection legislation could introduce specific rules for RFID systems and more particularly, rules establishing technical solutions, since it is difficult to achieve privacy by design by self-regulation. Such rules are already foreseen in the Framework PIA as mentioned above, but they would be more effective once included in mandatory rules.
